WHO PAYS A BEER PRIVILEGE TAX?

bulletTennessee Code Annotated 57-5-104 requires that any person, firm, corporation, joint-stock company, syndicate or association engaged in the selling, distributing, storing or manufacturing beer shall remit a $100.00 Privilege Tax to the County Clerk each year on January 1st but no later than January 31. 
bulletIf any person, firm, corporation, joint-stock company, syndicate or association obtains a Rutherford County Beer Permit after January 31 of the year a privilege tax shall be due on the following prorated basis:

January - $100.00

February - $91.63

March - $83.30

April - $74.97

May - $66.64

June - $58.31

July - $49.98

August - $41.65

September - $33.32

October - $24.99

November - $16.66

Please Note: If a beer permit holder does not pay the Privilege Tax by January 31, the Rutherford County Beer Board shall suspend or revoke the beer permit or impose a civil penalty upon the owner of the beer permit if the Privilege Tax is not paid within ten (10) days after receiving notice of delinquency by certified mail from the Rutherford County Clerk.    Where a Beer Permit has been revoked, no new Beer Permit shall be issued to permit the sale of beer on the same premises until after the expiration of one (1) year from the date the revocation becomes final and effective.  The Rutherford County Beer Board, at its discretion, may determine that issuance of a Rutherford County Beer Permit before the expiration of one (1) year from the date of revocation becomes final is appropriate, if the individual applying for such issuance is not the original holder of the Beer Permit or any family member who could inherit from such individual under the statute of intestate succession.

HOW CAN I PERFORM A CRIMINAL SEARCH ON MY EMPLOYEES?

bulletTennessee Code Annotated 57-5-105(a)(3) states..."No person, firm, joint-stock company, syndicate or association having at least a five (5%) percent interest in the beer establishment nor any person to be employed in the distribution or sale of beer be convicted of any violation of the laws against possession, sale, manufacture, or transportation of beer or other alcoholic beverages or any crime involving moral turpitude within the past ten (10) years".

Q.  How much distance must my beer establishment be from the nearest church or school?

A.  A beer establishment must be at least 600 feet from the nearest church or school.  The straight-line measurement shall be used to determine the exact distance.  The measurement must be taken from the nearest point of the beer establishment to the nearest point of the church or school (measured as the crow flies).

 

Q.  If I am required to obtain a certified survey to prove that my beer establishment is at least 600 feet from the nearest church or school, then how do I get a survey?

A. A certified surveyor can prepare a survey showing the distance from your establishment to the nearest church and school.  Look under Surveyors in the yellow pages of the telephone directory for a surveyor in your area. 

 

Q.  Can the Rutherford County Beer Permit be applied for in my manager's name? 

A.  No!  Tennessee Code Annotated 57-5-103(a)(2) states...Permits shall be issued to the owner of the business, whether a person, firm, corporation, joint-stock company, syndicate, or association.

 

Q.  What should I do with my Rutherford County Beer Permit if I close my business, change ownership of my business, relocate my business or change the name of my business? 

A.  Tennessee Code Annotated 57-5-103(a)(6) states...A permit holder must return a permit to the county or the city that issued it within fifteen (15) days of termination of the business, change in ownership, relocation of the business or change of the business's name; provided, that notwithstanding the failure to return a beer permit, a permit shall expire on termination of the business, change in ownership, relocation of the business or change of the business's name.

 

Q.  What is the legal age to purchase beer?

A.  It is unlawful for any person under the age of twenty-one (21) to purchase, possess, transport or consume alcoholic beverages (including beer).

 

Q.  What is the legal age to sell beer?

A.  A person eighteen (18) years of age or older may transport, possess, sell or dispense alcoholic beverages (including beer) in the course of their employment.
