LEGISLATIVE DIGEST OF THE RUTHERFORD COUNTY BOARD OF COMMISSIONERS THURSDAY, DECEMBER 13, 2001
A. The regular session of the Rutherford County Board of Commissioners was called to order by Madam Chairman, Nancy R. Allen on Thursday, December 13, 2001 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.
B. Court Chaplain Trey Gooch led the Invocation.
C. Riverdale Football Player, Jamal Price led the Pledge of Allegiance to the Flag of the United States of America.
D. Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting.
E. The November 15, 2001 Legislative Meeting Minutes were adopted as typed.
F. RESOLUTIONS OF SYMPATHY
1. The Resolution of Sympathy in memory of Sarah Jane Mathena was adopted. 2. The Resolution of Sympathy in memory of Gerry Ray was adopted. 3. The Resolution of Sympathy in memory of James Andrew Stankwytch was adopted.
G. The Resolution of Recognition in honor of the 2001 Riverdale Warrior Football Team was adopted.
H. The Resolution of Recognition in honor of Riverdale Warrior Football player, John Batey was adopted.
I. The Resolution of Recognition in honor of Riverdale Warrior Football player, Ralph King was adopted.
J. PUBLIC COMMENTS

K. ELECTIONS & CONFIRMATIONS
1. The Notary Public-at-Large Applications as presented by the Office of the Rutherford County Clerk were approved. 2. Four vacancies on the Agricultural Advisory Board were announced. 3. Two vacancies on the Correctional Work Center Board were announced. 4. Five vacancies on the Public Building Authority were announced.

M. PUBLIC HEARINGS-6:30 P.M.
N. REPORTS BY STANDING COMMITTEES
a. A recommendation to approve the December 11, 2001 Purchasing Committee Report was adopted.
2. BUDGET, FINANCE & INVESTMENT COMMITTEE
a. A resolution and inducement agreement approving the financing by the Industrial Development of Rutherford County, Tennessee relative to EDM Investments, L.L.C. was presented. The rules were suspended to allow Randy Brewer and/or John Harney to answer questions from the Rutherford County Board of Commissioners with regard to the proposed bond. After discussion the resolution and inducement agreement was adopted. b. A recommendation to amend the General Fund for the following was adopted: 1. County Clerk 2. Ambulance Service 3. Sheriff’s Department 4. Drug Court c. A resolution authorizing the County Executive to enter into an agreement on behalf of Rutherford County, Tennessee with J & S Properties with regard to property located at 106 East College Street for the purpose of office space for the Rutherford County Drug Court was adopted. d. A recommendation amending the General Fund, Solid Waste/Sanitation Fund, Special Purpose Fund and the Road and Bridge Fund with regard to employer share of the increase in premium rates for the Rutherford County’s Employee Health Insurance was adopted. e. A recommendation to amend the Solid Waste/Sanitation Fund with regard to employee benefits was adopted. f. A resolution authorizing a $25,000 advance from the General Fund to the Special Purpose Fund for certain grant programs was adopted. g. A recommendation authorizing the settlement of condemnation actions with regard to the improvement of road conditions for Stewartsboro School was adopted. h. The General Purpose School Fund was amended with regard to insurance recoveries and basic educational programs. i. A resolution to approve the funding for the replacement of HVAC units for Oakland and Riverdale High Schools was adopted. j. A resolution authorizing the issuance of General Obligation School Bonds not to exceed $3,500,000.00 for the purpose of funding initial testing and design for Christiana Middle School was adopted. k. A resolution to authorize funding to create gender equity in sports was presented. The rules were suspended to allow Jeff Sandvig, from the Rutherford County School System, to answer questions from the Rutherford County Board of Commissioners with regard to the resolution. After discussion the resolution was adopted as presented. l. A resolution to impose the maximum local Litigation Tax allowable under Tennessee Law was adopted. m. The Budget Calendar for the fiscal year of 2002 – 2003 was adopted.
3. HEALTH & EDUCATION COMMITTEE
a. No Report.
4. PROPERTY MANAGEMENT COMMITTEE
a. A resolution to approve a lease agreement with DeeAnn Nicodemus for property located at 3005 Guy James Road, a lease agreement with Brit and Frankie Russell for property located at 3009 Guy James Road and a lease agreement with Johnny Hall located at 3829 Browns Mill Road was adopted.
5. PUBLIC SAFETY COMMITTEE
a. A resolution authorizing the County Executive to enter into a Limited Use Agreement on behalf of Rutherford County, Tennessee with the United States Marshals Service relative to juvenile detention care services was adopted.
6. PUBLIC WORKS & PLANNING COMMITTEE
a. A resolution containing a list, submitted by the Rutherford County Road Superintendent, of all Rutherford County Roads was adopted.
a. A resolution establishing written descriptions of the twenty-one Commission Districts in Rutherford County was adopted. b. A resolution urging the State Legislature to support any bills that would relieve counties and cities of imposed unfunded State mandates was adopted.
a. A copy of a change in the landlord laws was passed out to each Commissioner. b. County Attorney, James C. Cope gave a brief report with regard to who State Constitutional Fee Office Holders reports to.
There being no further business, Madam Chairman, Nancy R. Allen adjourned the Rutherford County Board of Commissioners Legislative Meeting at 8:50 p.m.
