THURSDAY, DECEMBER 12, 2002

 

A.        Chairman Nancy R. Allen called the regular session of the Rutherford County Board of Commissioners to order on Thursday, December 12, 2002 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.

 

B.        Commission Court Chaplain, Trey Gooch led the Invocation.

 

C.       Commissioner Carol Cook led the Pledge of Allegiance to the Flag of the United States of America.

 

D.       Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting.

 

E.        The November 14, 2002 Legislative Meeting Minutes were adopted as typed.

 

F.        RESOLUTIONS OF APPRECIATION

 

1.         The Resolution of Appreciation in honor of E. Paul Long. was adopted.

2.         The Resolution of Appreciation in honor of Joe McKenzie was adopted.

3.         The Resolution of Appreciation in honor of Eris Read was adopted.

4.         The Resolution of Appreciation in honor of J. Hulon Watson was adopted.

 

G.       PUBLIC COMMENTS

 

1.      Carol Kluver spoke with regard to the wetlands.

 

H.        ELECTIONS & CONFIRMATIONS

 

1.      The Notary Public-at-Large Applications, as presented by the Office of the Rutherford County Clerk, were approved.

2.      The appointment of Mike Nunley to serve as County Coroner was adopted.

3.      Three vacancies were announced on the Agricultural Advisory Board.

4.      Two vacancies were announced on the Correctional Word Center Board.

5.      The appointment of Delia Goodman (Soil Conservation), Tom Stinson (Environmental), Edward Nelson (Minority), Tommy Gentry (Farm Bureau) Carter Woodruff (Consolidated Utility District), Mayo Taylor (Civic), and Rick Cantrell (Builder/Developer) to the Stormwater Citizens Advisory Committee was confirmed.

 

I.    UNFINISHED BUSINESS

 

   1.  No Report.

 

J.    PUBLIC HEARINGS-6:30 P.M.

             

  1. Faye and Doug Johns spoke in favor and Steve Schrader spoke regarding the property at the Public Hearing held with regard to the request from Faye and Doug Johns.  The request to amend the Conditional Use permit for the property located at 5602 West Jefferson Pike to allow a tire repair shop, general automotive repair shop, and increase the number of vehicles allowed on site to forty in the Commercial Zone was denied.

 

K.  REPORTS BY STANDING COMMITTEES

 

  1. PURCHASING COMMITTEE

 

a.      The Purchasing Committee report was adopted as mailed out.

 

2.      BUDGET, FINANCE & INVESTMENT COMMITTEE

 

a.      A recommendation to amend the General Fund with regard to the following was adopted:

1.  Ambulance Service

2.  Health Department

3.  Sheriff’s Department (2)

b.      A recommendation to amend the Solid Waste/Sanitation Fund was adopted.

c.      A recommendation to amend the Road and Bridge Fund was adopted.

d.      A recommendation to amend the General Purpose School Fund Budget was adopted.

e.      A recommendation to approve funding for Motlow State Community College was brought up.  The rules were suspended to allow Smyrna Mayor Bob Spivey to address the Board.  After discussion, the recommendation was adopted.

f.        A recommendation to approve funding for the cost of roof repairs for the Linebaugh Library, along with the professional fees, be shared equally with the City of Murfreesboro was adopted.

g.      A recommendation to approve funding for Architect/Engineer to develop plans to relocate a Juvenile Courtroom in the Judicial Building in the current space occupied by the District Attorney General was brought up but amended.  The motion was amended to expand the scope of work to include general preliminary design for the Rutherford County Workhouse and the Rutherford County Juvenile Detention Center as long as the money shall last that has been appropriated.  The original motion as amended was adopted.

h.      A recommendation approving the facsimile signatures for the Rutherford County Payroll Account was adopted.

i.        A recommendation approving the 2003-2004 Budget calendar was adopted.

j.         Information relative to new reporting in Comprehensive Annual Financial report was presented by Finance Director, Paul Long.

 

3.      HEALTH & EDUCATION COMMITTEE

 

            a.   No Report.

 

4.      PROPERTY MANAGEMENT COMMITTEE

 

a.      A resolution to approve the Facilities Master Plan prepared by RM Plan Group in association with Rufus Johnson & Associates as the final approved and authorized plan for the County office and Court space needs study was adopted.

b.      A resolution designating the former Health Department’s original building as the County Archives Building was adopted.

c.      A resolution regarding requesting Swanson Development, LP to reimburse Rutherford County for the purchase of the proposed animal shelter site on Capt. Joe Fulghum Drive was adopted.

 

      5.  PUBLIC SAFETY COMMITTEE

 

a.      No Report.

 

6.   PUBLIC WORKS & PLANNING COMMITTEE

 

a.      A resolution to approve and accept the 2003 Rutherford County Road Book was adopted.

b.      A resolution approving that the maximum speed limit be 40 miles per hour for all motor vehicles traveling on JD Todd Road was adopted.

c.      A resolution to approve a Warranty Deed to the State of Tennessee for transfer of 981 square feet on State Route 10 was adopted.

 

  1. STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE

 

a.      A resolution to approve a Private Act to create a central Human Resources Department in Rutherford County was adopted.

b.      A resolution to approve adopting the Adult-Oriented Establishment Registration Act of 1998 was adopted.
