THURSDAY, OCTOBER 17, 2002

 

A.        Chairman Nancy R. Allen called the regular session of the Rutherford County Board of Commissioners to order on Thursday, October 17, 2002 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.

 

B.        Commission Court Chaplain, Trey Gooch led the Invocation.

 

C.       Commissioner Mike Sparks led the Pledge of Allegiance to the Flag of the United States of America.

 

D.       Twenty Rutherford County Board of Commissioners were present for the Legislative Meeting.

 

E.        The September 12, 2002 Legislative Meeting Minutes were adopted as typed.

 

F.        RESOLUTIONS OF SYMPATHY

 

1.         The Resolution of Sympathy in memory of Justin Brant Boyd was adopted.

2.         The Resolution of Sympathy in memory of Phillip Gerald Boyd was adopted.

 

G.       A Resolution regarding Red Ribbon Week being observed during the week of October 23 – 31 was
        adopted.

 

H.        Nell Blankenship presented County Executive Nancy Allen a book regarding Rutherford County
        from the Historical Society.

 

I.            PUBLIC COMMENTS

 

1.      Dan Sinclair spoke with regard to Linebaugh Library Roof.

2.      Carol Kluver spoke with regard to swamp lands.

 

J.         ELECTIONS & CONFIRMATIONS

 

1.      The Notary Public-at-Large Applications, as presented by the Office of the Rutherford County Clerk, were approved.

2.      The Board appointed County Commissioner Will Jordan to serve on the Agricultural Advisory Board.

3.      The Board appointed Jerry D. Sartain to serve on the Board of Zoning Appeals.  Jason B. Halcomb and Linda Lichtenberger were appointed to serve as alternates on the Board of Zoning Appeals.

4.      The Board appointed Mike Avery and Carol Uselton to serve on the Beer Board.  Jason Holcomb was appointed to serve as an alternate on the Beer Board.

5.      Two Commissioner vacancies were announced on the Insurance Committee.

6.      A Commissioner vacancy was announced on the Records Commission.

 

K.    UNFINISHED BUSINESS

 

   1.  No Report.

 

L.    PUBLIC HEARINGS-6:30 P.M.

             

  1. One person spoke for and no one spoke against at the Public Hearing held with regard to the request from Faye and Doug Johns.  The request to amend the Conditional Use Permit at property located at 5602 West Jefferson Pike from Commercial to Amendment: Tire Repair Shops, General automotive repair shops, and to increase the number of vehicles onsite to forty (40) was approved subject to the maximum number of vehicles being increased to twenty (20) in 30 days.  Mr Davis will determine compliance and will inform the County Commission in writing.
  2. No one spoke for or against at the Public Hearing held with regard to the request from Herman P. Waddell.  The request to amend the Conditional Use Permit at property located at 8385 John Bragg Highway from Services with Amendment to remove requirement to buffer along the rear and sides of the zoned area inside the TVA Easement and change the hours of operation was approved with conditions as recommended by the Rutherford County Planning Commission .

 

M.   MONTHLY & QUARTERLY REPORTS

 

      1.   The Monthly and Quarterly Reports were approved as mailed out.    

 

N.   REPORTS BY STANDING COMMITTEES

 

  1. PURCHASING COMMITTEE

 

            a.   The Purchasing Committee report was adopted as mailed out.

 

 

 

            2.      BUDGET, FINANCE & INVESTMENT COMMITTEE

 

a.      A recommendation to amend the General Fund with regard to the following was adopted:

1.  Election Commission

2.  Health Department

3.  County Buildings/Jail

4.  Ambulance Service

5.  Sheriff’s Department (3)

b.      A recommendation to approve a grant agreement between Rutherford County and the State of Tennessee, State Library and Archives for the acquisition of equipment, supplies and furnishings to house, keep, preserve and make available permanently valuable records of the State of Tennessee was adopted.

c.      A recommendation to approve a grant agreement from the Christy Houston Foundation to be used to fund critical care training for twenty-eight (28) paramedics was adopted.

d.       A recommendation to approve a grant agreement between Rutherford County and the State of
 Tennessee, Commission on Children and Youth to allow the hiring of a prosecutor for Juvenile
 Court, software purchase and installation for the Juvenile Detention Center and to provide funding
 for multiple services to delinquent offenders in Rutherford County was adopted.

e.      A recommendation authorizing the County Executive to accept the 2002 Local Law Enforcement Block Grant from the United States Department of Justice for the acquisition of equipment for various departments was adopted.

f.        A recommendation to approve a three-year COPS-In-School Grant from the United States 
Department of Justice to allow for the hiring of three (3) new, additional full-time School Resource Officers was adopted.

g.      A recommendation to approve a three-year COPS Universal Hiring Program Grant Award from the United States Department of Justice to allow for the hiring of fifteen (15) new full-time officer positions was adopted.

h.      A recommendation to amend the Solid Waste/Sanitation Fund was adopted.

i.        A recommendation to amend the Special Purpose Fund to provide funding for a refund to the Christy-Houston Foundation for unexpended grant funds from the 2001-2002 fiscal year was adopted.

j.         A recommendation to amend the General Purpose School Fund to appropriate additional Basic Educational Program funds to eliminate student fees was adopted.

k.      A recommendation to approve the cost of the roof repairs for the Linebaugh Library, along with the professional fees, be shared equally with the City of Murfreesboro was presented.  The rules were suspended to allow Dan Sinclair to answer questions regarding the roof.  The original motion was amended allowing the County Executive to negotiate with the City of Murfreesboro and the Linebaugh Library Board and to bring that recommendation back through to the Budget and Finance Committee and to the full Commission.  The original motion as amended was adopted.

l.         A recommendation to approve a grant agreement between Rutherford County and the Regional Transportation Authority for the provision of transit services between Nashville/Davidson County and Murfreesboro/Rutherford County by which Rutherford County will receive service benefits was adopted.

 

            3.      HEALTH & EDUCATION COMMITTEE

 

a.      No report.

 

            4.      PROPERTY MANAGEMENT COMMITTEE

 

a.      No Report.  

 

      5.  PUBLIC SAFETY COMMITTEE

             a.   No Report.

 

6.   PUBLIC WORKS & PLANNING COMMITTEE 

a.      A resolution to approve a 20 m.p.h. speed limit for Church Street in Christiana and a 15 m.p.h. speed limit for Suggs Street, Main Street, Daniel Street, and Miller State in Christiana was adopted. 

 

  1. STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE

     a.   A resolution requesting the Rutherford County Finance Director to serve in an advisory position on
           the Audit Committee was adopted.         

 

There being no further business, Madam Chairman, Nancy R. Allen adjourned the Rutherford County Board of Commissioners Legislative Meeting.
