BOARD OF COMMISSIONERS

 

OCTOBER 12, 2000

 

A.        The regular session of the Rutherford County Board of Commissioners was called to order by Chairman Pro-Tem, Allen McAdoo at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.

 

B.        Board of Commissioners Court Chaplain, Paul Johnson led the Invocation.

 

C.       Commissioner David T. Gammon led the Pledge of Allegiance to the Flag of the United States of America.

 

D.       Twenty Rutherford County Board of Commissioners were present for the Legislative Meeting.

 

E.        The Board of Commissioners adopted the September 14, 2000 Legislative Meeting Minutes as typed.

 

F.        RESOLUTIONS OF SYMPATHY:

 

1.      The Board of Commissioners adopted a Resolution of Sympathy in memory of Hellon Johns Hall

2.      The Board of Commissioners adopted a Resolution of Sympathy in memory of Jane D. Hutchinson.

3.      The Board of Commissioners adopted a Resolution of Sympathy in memory of Alma Summar Vaughn.

4.      The Board of Commissioners adopted a Resolution of Sympathy in memory of Roy L. Wood.

 

G.       The Board of Commissioners suspended the Rules for the next item not on the Agenda.  After being presented a petition from
        constituents from the 10th and 11th Districts, the Board of Commissioners approved a motion to reapportion an area of the
       10th District into the 11th District, which includes Rosemont Terrace, Newburgh Court, and a portion of Stewart Valley Drive.

 

H.        ELECTIONS & CONFIRMATIONS

 

1.      The Board of Commissioners approved the Notary Public-at-Large Applicant List as mailed out by the Office of the Rutherford County Clerk.

2.      The Board of Commissioners was informed of the 11th District Commissioner Vacancy.

3.      The Board of Commissioners was informed of a vacancy on the Industrial Development Board and Health, Education & Facilities Board.

4.      The Board of Commissioners was informed of two vacancies on the Insurance Committee and was further informed that a Commissioner would fill one of the vacancies. 

5.      The Board of Commissioners suspended the Rules for the next item not on the Agenda.  The Board of Commissioners appointed Greg Hall and Bobby Thompson to serve on the Insurance Committee.

6.      The Board of Commissioners was informed of a vacancy on the Highway Commission for Zone #3. 

7.      The Board of Commissioners appointed Betty Lester to the Board of Zoning Appeals for a five-year term.  

8.      The Board of Commissioners adopted a Resolution staggering the terms of the Rutherford County Beer Board and made the following appointments to the Rutherford County Beer Board:

·        Alford Fann to serve a three year term;

·        William K. Bratcher to serve a three year term;

·        Mike Avery to serve a two year term;

·        Carroll Uselton to serve a two year term;

·        Jerry Sartain to serve a one year term;

·        George Weeks to serve as an alternate for a two year term; and

·        James T. Victory to serve as an alternate for a one year term

               After the expiration of the initial terms, all Beer Board appointments will be for three-year terms.

9.      The Board of Commissioners confirmed the appointment of John M. Green to the Cultural Arts Commission.

 

I.     UNFINISHED BUSINESS

   1.  No Report.

 

J.    MONTHLY & QUARTERLY REPORTS

 

1.      The Board of Commissioners adopted the following Monthly and Quarterly Reports as mailed out:

·        Vocational Training Report

·        Building Permit Report

·        Griffin Industries Report

·        Mid-Cumberland Community Agency Report

 

 

K.   PUBLIC HEARINGS-6:30 P.M.

             

  1. The Board of Commissioners held a Public Hearing on the request from L&N Construction to rezone property located at 2528 Halls Hill Pike for a Conditional Use Permit to allow apartments in the Residential-20 Zone.  One person spoke for the request and no one spoke against the request.  The Board of Commissioners then approved the request along with the conditions as recommended by the Rutherford County Planning Commission.
  2. The Board of Commissioners held a Public Hearing on the request from Billy Hayes to rezone property located at 4447 Veals Road from Residential-20 to Retail and Wholesale Trade with a Conditional Use Permit to allow 5093-Scrap and Waste materials, 5521-Motor Vehicle Dealers (Used Only), and 7538-General Automotive Repair Shops in the Retail and Wholesale Trade Zone. No one spoke for or against the request.  The Board of Commissioners then denied the request.
  3. The Board of Commissioners held a Public Hearing on the request from Kavipnon Vanisouvong to rezone property located at 3904 Veals Road from Residential-20 to Services with a Conditional Use Permit to allow 7532-Automotive Body Shop, 7538-General Automotive Repair Shops in the Services Zone, and a Single Family Dwelling.  No one spoke for or against the request.  The Board of Commissioners then approved the request along with the conditions as recommended by the Rutherford County Planning Commission.
  4. The Board of Commissioners held a Public Hearing on the request from James H. Thomas to rezone property located at 3985 Shelbyville Highway for an Amendment to Conditional Use Permit Number A-432 to allow 4226-Commercial Holding Area for Towed Cars/Trucks and 7549-Commercial Towing Services.  No one spoke for the request and three people spoke against the request.  The Board of Commissioners then denied the request.
  5. The Board of Commissioners held a Public Hearing on the request from Don Mofield for property located at 1925 Factory Road for an Amendment to Conditional Use Permit Number A-412 to increase total cars allowed to twenty (20).  One person spoke for the request and no one spoke against the request.  The Board of Commissioners then approved the request along with the conditions as recommended by the Rutherford County Planning Commission.

 

L.   REPORTS BY STANDING COMMITTEES

 

  1. PURCHASING COMMITTEE

 

a.      The Board of Commissioners adopted the Purchasing Committee Report as mailed out.

 

2.      BUDGET, FINANCE & INVESTMENT COMMITTEE

 

a.      The Board of Commissioners approved the General Fund Budget Amendments with regard to the following:

1.     Chancery Court

2.     Emergency Medical Services

3.     Health Department

b.      The Board of Commissioners approved the Local Purpose Tax Fund Budget Amendment authorizing Sixty-Six Thousand Eight Hundred Dollars ($66,800.00) for the purpose of providing funding for the Community Care roof replacement.

c.      The Board of Commissioners adopted a recommendation authorizing the County Executive to accept a Federal Local Law Enforcement Block Grant in the amount of Thirty Thousand Six Hundred One Dollars ($30,601.00) for the Sheriff’s Department.

d.      The Board of Commissioners adopted a recommendation authorizing the County Executive, Finance Director and Budget Committee Chairman to attend a public auction, Thursday, October 26, 2000, to bid, on behalf of Rutherford County, on property located at 810 Commercial Court in such amount as they deem reasonable. 

e.      The Board of Commissioners adopted a recommendation authorizing the County Executive, Finance Director and Budget Committee Chairman to attend a public auction Thursday, October 26, 2000, to bid, on behalf of Rutherford County, on property located at 415 North Maple Street in such amount as they deem reasonable. The Board further directed that the value as assessed by the Assessor of Property be used as a guideline to determine the price of the property.    

f.        The Board of Commissioners adopted a recommendation to support the concept of a new Emergency Medical Services Dispatch Center to be located on one acre of county-owned property on Southgate Boulevard.

 

3.      HEALTH & EDUCATION COMMITTEE

 

a.      No Report.

 

4.      PROPERTY MANAGEMENT COMMITTEE

 

a.      No Report.

 

      5.  PUBLIC SAFETY COMMITTEE

 

a.      No Report.

 

 

6.   PUBLIC WORKS & PLANNING COMMITTEE

 

a.      The Board of Commissioners adopted a Resolution granting to the Middle Tennessee Utility District of Cannon, Cumberland, DeKalb, Putnam, Rhea, Rutherford, Smith, Warren, White and Wilson Counties the exclusive right and franchise to use and occupy public ways within the area of Rutherford County, Tennessee.              

b.      The Board of Commissioners adopted a Resolution that the maximum speed limit shall be 15 miles per hour for all motor vehicles travelling on Milton Street and Old Highway 96 (Lascassas Pike to Jefferson Pike).  The Board of Commissioners also adopted a Resolution that the maximum speed limit shall be 20 miles per hour for all motor vehicles travelling on Banks Street.

c.      The Board of Commissioners adopted a Resolution that Rutherford County accept the abandoned portion of Highway 269 a/k/a Christiana Lane and add it to the Rutherford County Road Book.

 

  1. STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE

 

a.      The Board of Commissioners adopted a Resolution amending Commission Rules and Regulations regarding the replacement of an elected Commissioner whom for whatever reason is unable to serve until the expiration of his/her elected term. 

b.      The Board of Commissioners approved a motion directing Ben Mankin to place strip lighting around the step area close to the public seating in the Courthouse courtroom.

 

There being no further business, Chairman Pro-Tem, Allen McAdoo adjourned the Rutherford County Board of Commissioners Legislative Meeting at 8:30 p.m.
