 THURSDAY, OCTOBER 11, 2001

 

A.        The regular session of the Rutherford County Board of Commissioners was called to order by Chairman Pro-Tem, Allen McAdoo on Thursday, October 11, 2001 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee. 

B.        Commission Court Chaplain, Trey Gooch led the Invocation. 

C.       Commissioner David T. Gammon led the Pledge of Allegiance to the Flag of the United States of America. 

D.       Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting. 

E.        The September 13, 2001 Legislative Meeting Minutes were adopted as typed.

 

F.        RESOLUTIONS OF SYMPATHY 

1.         The Resolution of Sympathy in memory of Martha Tomlinson Jones was adopted.

2.         The Resolution of Sympathy in memory of Terry Austin Watson was adopted.

 

G.       The Resolution of Recognition in honor of Cedar Grove Elementary School was adopted.

 

H.        PUBLIC COMMENTS 

1.      Vicki Haddock spoke favorably with regard to a truck to be used by the Mounted Horse Patrol for
 the Rutherford County Sheriff’s Department.

2.    Kristen McDonald spoke favorably with regard to a truck to be used by the Mounted Horse Patrol
 for the Rutherford County Sheriff’s Department.

3.      Paul Diamond spoke favorably with regard to keeping the Rural Growth Boundary as earlier
approved by the Rutherford County Board of Commissioners.

4.      Frank Beard spoke favorably with regard to the Buchanan Sewer Project in his community.

5.      Bud Elliott spoke favorably with regard to the Buchanan Sewer Project in his community.

6.      Sonny Elam spoke favorably with regard to the Buchanan Sewer Project in his community. 

 

I.            ELECTIONS & CONFIRMATIONS 

1.      The Notary Public-at-Large Applications as presented by the Office of the Rutherford County
Clerk were approved.

2.      Zane Cantrell was appointed to serve a five-year term on the Board of Zoning Appeals.

3.      Carolyn S. Overton was appointed to serve as Judicial Commissioner for a term not to exceed four
years and such term to conclude and terminate if and when the term is concluded or the service
with Rutherford County terminates.

 

J.    UNFINISHED BUSINESS 

   1.  No Report.

 

K.   MONTHLY & QUARTERLY REPORTS 

1.  The Monthly & Quarterly Reports were approved as mailed out.

 

L.    PUBLIC HEARINGS-6:30 P.M.             

  1. No one spoke against at the Public Hearing held with regard to the request from Anne M. Swaim.  Anne M. Swaim spoke in favor of her own request.  The request to rezone property located at 3559 April Lane from Residential-15 to a Conditional Use Permit for a Day Care Center was approved along with the conditions as recommended by the Rutherford County Planning Commission.
  2. No one spoke at the Public Hearing held with regard to the request from Kathryn S. Neese.  The request to rezone property located at 9692 Franklin Road from Commercial to a Conditional Use Permit for Manufacturing 3342 – Metal Door, Sash, Frames, Molding, and Trim, and 3446 – Architectural and Ornamental Metal Work was approved along with the conditions as recommended by the Rutherford County Planning Commission.
  3. No one spoke at the Public Hearing held with regard to the request from John D. Allen.  The request to rezone property located at 3498 Leanna Road from Residential-15 to a Conditional Use Permit for 5039 – Retail Sale of Prefabricated Barns was approved along with the conditions as recommended by the Rutherford County Planning Commission.
  4. No one spoke at the Public Hearing held with regard to the request from Randy J. Andrus.  The request to rezone property located at 5858 Lee Road from Residential-15 to a Conditional Use Permit for a Cabinet Making Shop was approved along with the conditions as recommended by the Rutherford County Planning Commission.
  5. No one spoke at the Public Hearing held with regard to the recommendation to amend the Rutherford County Zoning Resolution.  The request to amend the Rutherford County Zoning Resolution with regard to Article XV relative to Residential Districts was approved as recommended by the Rutherford County Planning Commission.

 

M.  REPORTS BY STANDING COMMITTEES 

  1. PURCHASING COMMITTEE

 

a.      A recommendation to approve the September 13, 2001 monthly Purchasing Committee Report was adopted.

b.      A recommendation to approve the October 9, 2001 monthly Purchasing Committee Report was adopted.

 

2.      BUDGET, FINANCE & INVESTMENT COMMITTEE

a.      A recommendation requesting Department Heads to develop a plan to reduce spending by five
percent was adopted.

b.      A recommendation to amend the General Fund for the following was adopted:

1.  Ambulance Service

2.  Circuit Court Judge

3.  Planning & Engineering

4.  Preliminary Funding for Agriculture Extension Center Project

5.  Miscellaneous (NYCDC Disaster Relief Fund)

c.      A recommendation to amend the Local Purpose Tax Fund was adopted.

d.      A Resolution authorizing the issuance of revenue bonds, by the Health and Education Facilities Board,
in the amount of $5,000,000.00 for Tennessee Family Solutions Housing & Support, Inc. was adopted.

e.      A recommendation to authorize Bob Shupe to negotiate the renewal rate for the Property &
Casualty Insurance with the County’s current carrier was adopted.

f.        A recommendation to authorize the County Executive to make the seven control costs changes
with regard to the Rutherford County’s Health Insurance Plan was adopted.

g.      A recommendation authorizing the County Executive to execute an agreement with the
Tennessee Department of Health relative to services provided by Rutherford County Health Director,
Tela N. Bayless was adopted.

h.      A recommendation authorizing the County Executive to accept a COPS in School Grant in the
amount of $618,600.00 for the purpose of hiring five School Resource Officers.

i.        A recommendation to transfer monies from the Local Purpose Tax Fund (Development Tax) to the
General Fund for the purchase of five patrol vehicles to be used by the new School Resource
Officers was presented.  An amendment to the original recommendation to require that the five patrol
vehicles be funded from the Drug Fund was also presented.  The rules were suspended to allow
Sheriff Truman Jones to address the Board with regard to both recommendations.  The
original recommendation was adopted as amended.

j.         A recommendation to appropriate monies from the Local Purpose Tax Fund (Development Tax)
and to transfer monies within the Solid Waste/Sanitation Fund for paving the Landfill Road was adopted.

k.      A recommendation to amend the General Purpose School Fund with regard to a Technology Literacy Grant
for Cedar Grove School was adopted.

l.         A recommendation to issue General Obligation School Bonds in the amount of $3,700,000.00 with regard
to the Blackman and Rock Springs Middle Schools Project was adopted.

m.    A recommendation authorizing the County Executive to execute a Grant Agreement with the
Tennessee Department of Environment and Conservation with regard to Option Three for the collection
of Waste Tires was adopted.

n.      A resolution authorizing the County Executive to execute a Contract with the Town of Smyrna for the
operation and maintenance of Traffic Signals was adopted.

o.      A recommendation to amend the Rutherford County Personnel Policy with regard to loss of pay or
benefits during part or all of active military duty was adopted.

p.      The rules were suspended for the next item not on the agenda and to allow Sheriff Truman Jones to
address the Board regarding the monies needed to purchase a truck for the Mounted Patrol. 
A recommendation to amend the Drug Control Fund in the amount of $30,000.00 for the purchase of
a truck for the Sheriff’s Department Mounted Patrol was presented.  An amendment to the
original recommendation to change the amount to $25,000.00 and that the monies be taken out of
each fund on a 50/50 basis was presented.  The original recommendation was adopted,
however the amendment failed.

 

3.      HEALTH & EDUCATION COMMITTEE

a.      No report.

 

4.      PROPERTY MANAGEMENT COMMITTEE

a.      No report.

      5.  PUBLIC SAFETY COMMITTEE

 

a.      No report.

 

6.   PUBLIC WORKS & PLANNING COMMITTEE 

a.      A resolution to set a 45-mile per hour speed limit for all motor vehicles traveling on College Grove
Road was adopted.

b.      A resolution requesting the deletion of the last 410 feet of River Lane from the Rutherford County
Road Book was adopted.

c.      A resolution authorizing the County Executive to execute a Contract with the State of Tennessee,
Department of Transportation for the installation and maintenance of a traffic signal at State Route
840 with State Route 452 interchange was adopted.

 

  1. STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE

a.      A resolution requiring the Industrial Development Board and the Health and Education Facilities
Board to submit all Bond Issues for review and approval to the Budget, Finance and Investment
Committee and to send all meeting notices to the County Executive for dissemination
to County Commissioners was adopted.

 

  1. ANY OTHER BUSINESS

a.  The rules were suspended to revisit the funding of the five patrol cars.

     A recommendation to fund the five patrol vehicles from the 

     Development Tax Fund was adopted.

 

There being no further business, Chairman Pro-Tem, Allen McAdoo adjourned the Rutherford County Board of Commissioners Legislative Meeting at 8:36 p.m.
