A. Madam Chairman Nancy Allen called the regular session of the Rutherford County Board of Commissioners to order on Thursday, August 17, 2006 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.
B. Commissioner Doug Shafer led the Invocation.
C. County Mayor Elect, Earnest Burgess, led the Pledge of Allegiance to the Flag of the United States of America.
D. Twenty One (21) Rutherford County Board of Commissioners were present for the opening of the Legislative Meeting.
E. The June 26, 2006, Legislative Meeting Minutes was adopted.

1. The Notary Public-at-Large Applications, as presented by the Office of the Rutherford County Clerk, were approved.
2. Angela Randolph and Sharon Davis were appointed Judicial Commissioners. 3. Three (3) vacancies on the Insurance Committee were announced. 4. Three (3) vacancies on the Codes Enforcement Board were announced. 5. A vacancy on Equalization Board was announced – to fill unexpired term of Jeffrey Day 6. Allen Swader’s reappointment to the Planning Commission was confirmed. 7. Linda Stevens and Grant Kelley reappointment was confirmed and Mimi Keisling was appointed to the Central Region Solid Waste Planning Board.

1. Conditional Use Permit request (A-772) of Jeff Hurst, 6945 Shelbyville Pike, was considered and approved with conditions. 2. Conditional Use Permit request (A-775) of Jose Gomez, John Bragg Highway, was considered and denied. 3. Conditional Use Permit request (A-777) of Jeffrey Williamson, 9289 Old Jackson Ridge Road, was considered and denied. 4. Conditional Use Permit request (A-779) of Clair Vanderschaff, 2133 Allisona Road, Eagleville, was considered and approved with conditions. 5. Amendment A-720 to Conditional Use Permit request (A-781) of Glen Mitchell, 5086 King Tucks Road, was considered and approved with conditions. 6. A. These General Fund Budget items were amended and approved: 1. Archives 2. Sherriff’s Department/Jail 3. Storm Water Management
B. Authorization to execute Contract Agreements with Tennessee Department of Children’s Services for (1) Juvenile Court Prevention and (2) Community Intervention Services.
C. Grant Agreements were approved with State of Tennessee for the Office of Criminal Justice Programs plus a related Budget Amendment for Drug Court. D. Agreements were approved for the acquisition of GIS data for the Consolidated Utility District and related budget amendments.
E. Insurance Premiums were approved for Property and General Liability Insurance.
F. A resolution was executed to establish a fixed rate reimbursement for Housing of State Prisoners @ Correctional Work Center.
G. A lease agreement was approved for a Mail Machine at the Health Department.
H. The Memorandum of Agreement was approved between Rutherford County and the Tennessee Department of Health to provide funding fo the services of Andre Fresco and Dr. Barton Warner.
I. The Development Tax Budget was amended to provide for funding of the renovation of the Old Health Department and Condemnation of property near Eagleville School.
J. An amendment to Rutherford County’s 2003 HOME Grant from the Tennessee Housing Development Agency was approved.
K. A resolution to authorize the acceptance of local Parks and Recreation Grant was approved.
L. Public Official Bonds were approved.
M. A resolution was approved allowing for the “facsimile” Signatures for County officials and the Rutherford County Payroll Account.

4. PROPERTY MANAGEMENT COMMITTEE
A. A resolution to authorize a water line easement at 502 Memorial Boulevard with the city of Murfreesboro was approved. B. A resolution addressing the water line easement with Consolidated Utility District for Burnt Knob Road was approved.
5. PUBLIC SAFETY COMMITTEE
A. No Report
6. PUBLIC WORKS & PLANNING COMMITTEE
A. A resolution entering into an agreement with the City of Murfreesboro for the maintenance of the traffic light at DeJarnett Lane and Highway 96 East was approved.

A. Commissioner Mike Sparks invited the commission and general public to the annual Smyrna Fish Fry
There being no further business, Madam Chairman, Nancy Allen, adjourned the Rutherford County Board of Commissioners Legislative Meeting. Time of adjournment: 7:45 pm.
