The regular session of the Rutherford County Board of Commissioners was
called to order by Madam Chairman, Nancy R. Allen at 6:00 p.m. in the Courtroom
located on the second floor of the Rutherford County Courthouse in Murfreesboro,
Tennessee. B.
Board of Commissioners Court Chaplain Trey Gooch, led the
Invocation. C.
Commissioner Joe Frank Jernigan led the Pledge of Allegiance to the Flag
of the United States of America. D.
Twenty Rutherford County Board of Commissioners were present for the
Legislative Meeting. E.
The Board of Commissioners adopted the June 26, 2000
Legislative Meeting Minutes and July 6, 2000 Legislative Meeting Minutes as
typed. F.
RESOLUTIONS OF SYMPATHY
1. The Board of Commissioners adopted a Resolution of Sympathy
in memory 2.
The Board of Commissioners adopted a Resolution of Sympathy in memory of
Camillus Brennus Huggins, IV. 3.
The Board of Commissioners adopted a Resolution of Sympathy in memory of
Hassel Bedford Smith, Jr. 4.
The Board of Commissioners adopted a Resolution of Sympathy in memory of
Ashley Tolbert. 5.
The Board of Commissioners adopted a Resolution of Sympathy in memory of
Gunther Woitke. G.
ELECTIONS & CONFIRMATIONS 1.
The Board of Commissioners approved the Notary Public-at-Large Applicant
List as mailed out by the Office of the Rutherford County Clerk. 2.
The Board of Commissioners was informed of five vacancies and two
alternate vacancies on the Beer Board. 3.
The Board of Commissioners was informed of two vacancies and one
alternate vacancy on the Codes Enforcement Adjustments & Appeals Board. 4.
The Board of Commissioners was informed of a Commissioner vacancy on the
Insurance Committee. 5.
The Board of Commissioners confirmed the appointments of Robert Stroop
and Bruce Gentry to the Regional Planning Commission. 6.
The Board of Commissioners appointed Wanda Y. Watkins, Casey L. Leonard
and Cherie L. Holley to serve as Judicial Commissioners for terms not to exceed
four years and such terms to conclude and terminate if and when the terms are
concluded or the service with Rutherford County is terminated. 7.
The Board of Commissioners tentatively elected Nancy R. Allen as
Commission Chairman. 8.
The Board of Commissioners elected Commissioners Robert Peay, Grant
Kelley, Tina Jones, Bob Bullen, Steve Johns, Jimmy Evans, and Steve Sandlin to
the Steering Committee. The
Steering Committee then elected Robert Peay as Chairman and Tina Jones as
Vice-Chairman. The Steering
Committee will meet the first Monday of the month at 6:00 p.m. with the
exception of the September meeting, which will meet Tuesday, September 5, 2000
at 6:00 p.m. H. UNFINISHED BUSINESS 1.
No Report. I. PUBLIC HEARINGS-6:30 P.M. 1.
The Board of Commissioners held a Public Hearing on the request from the
Future Development Committee for a proposed Amendment to the Zoning Resolution
Article VI, Section 6.06. No one
spoke for or against the request. The
Board of Commissioners then approved the Amendment along with conditions as
recommended by the Rutherford County Planning Commission. 2.
The Board of Commissioners held a Public Hearing on the request from
Michael L. Hollingshead to rezone property located at 4472 Hickory Grove Road,
Murfreesboro from R-20 to Manufacturing with a Conditional Use Permit to allow
Manufacturing 3273-Ready Mixed Concrete in the Manufacturing Zone.
No one spoke for or against the request.
The Board of Commissioners then approved the request along with the
conditions as recommended by the Rutherford County Planning Commission. 3.
The Board of Commissioners held a Public Hearing on the request from
Billy Hayes to rezone property located at 4447 Veals Road, Murfreesboro from
Residential-20 to Retail and Wholesale Trade with a Conditional Use Permit to
allow 5093-Scrap and Waste Materials, 5521-Motor Vehicle Dealers (Used Only),
and 7538-General Automotive Repair Shops in the Retail and Wholesale Trade Zone.
Billy Hayes spoke for the request. No
one spoke against the request. The
Board of Commissioners then deferred the request back to the Planning
Commission. 4.
The Board of Commissioners held a Public Hearing on the request from Ron
Smith to rezone property located at 2927 Elam Road, Murfreesboro from
Residential-20 to Construction with a Conditional Use Permit to allow
1741-Masonry, Stonework, and other Stonework and 1771-Concrete Work in the
Construction Zone. Ron Smith spoke
for the request. No one spoke
against the request. The Board of Commissioners then approved the request along
with the conditions as recommended by the Rutherford County Planning Commission. 5.
The Board of Commissioners held a Public Hearing on the request from
Patricia L. Hillard to rezone property located at 11899 Mona Road, Murfreesboro
from Residential-20 to Retail and Wholesale Trade with a Conditional Use Permit
to allow 5411-Convenience Stores in the Retail and Wholesale Trade Zone.
Mr. Hillard and Patricia Hillard spoke for the request.
No one spoke against the request. The Board of Commissioners then
approved the request along with the conditions as recommended by the Rutherford
County Planning Commission. 6.
The Board of Commissioners held a Public Hearing on the request from
George F. Howse for property located at 2851 Thompson Road, Murfreesboro for a
Conditional Use Permit to allow Agricultural Services 0279-Animal
Specialties-Dog Breeding in the Residential Zone. George F. Howse spoke for the
request and Tanya Nicholson, Maureen Blackwood, Lorene Soupelik, and Cynthia
French spoke against the request. The
Board of Commissioners then denied the request. 7.
The Board of Commissioners held a Public Hearing on the request from
Henry W. Duggin to rezone property located at 1211 East Jefferson Pike from
Residential-20 to Services with a Conditional Use Permit to allow 0782-Lawn and
Garden Services, 1799-Pressure Cleaning of Exterior Areas and a Single Family
Home in the Services Zone. No one
spoke for or against the request. The
Board of Commissioners then approved the request along with the conditions as
recommended by the Rutherford County Planning Commission. Chairman Nancy R. Allen
recessed the Board of Commission meeting for five minutes. J. REPORTS
BY STANDING COMMITTEES
a. The Board of Commissioners adopted the Purchasing Committee Report as mailed out. 2.
BUDGET, FINANCE & INVESTMENT COMMITTEE a. The Board of Commissioners approved the General Fund Budget Amendments with regard to the following: 1. Community Learning 2. Parks & Fair Boards (Recreation) 3. Health Department 4. Emergency Medical Services 5. Sheriff’s Department b. The Board of Commissioners adopted the Local Purpose Tax Fund Budget Amendment with regard to the following: 1. Ambulance Service c. The Board of Commissioners approved the Drug Control Fund Budget Amendments. d. The Board of Commissioners approved a recommendation that the County Executive be authorized to execute settlements of condemnation actions relating to the Stewartsboro Road project. e. The Board of Commissioners approved a Resolution authorizing the issuance, sale, and payment of interest bearing Employee Insurance Fund Revenue Anticipation Notes not to exceed to two million dollars. 3. HEALTH & EDUCATION COMMITTEE a. No Report. 4.
PROPERTY MANAGEMENT COMMITTEE a. The Board of Commissioners adopted a Resolution to approve the Renewal of Lease Agreement by and between Rutherford County, Tennessee and DeAnne Nicodemus for 3005 Guy James Road, Lascassas, Tennessee for a term of six months. b. The Board of Commisioners adopted a Resolution to approve the Renewal of Lease Agreement by and between Rutherford County, Tennessee and Brit and Frankie Russell for 3009 Guy James Road, Lascassas, Tennessee for a term of twelve months. c. The Board of Commissioners adopted a Resolution to approve the Renewal of Lease Agreement by and between Rutherford County, Tennessee and Johnny Hall for 3829 Browns Mill Road, Lascassas, Tennessee for a term of twelve months. d.
The Board of Commissioners approved a Resolution to request the
Rutherford County Board of Education and County Commission to consider a
condemnation process in future land acquisitions in the school building program
if property cannot be acquired at a negotiated fair price.
5. PUBLIC SAFETY
COMMITTEE a. No Report. 6.
PUBLIC WORKS & PLANNING COMMITTEE a.
The Board of Commissioners adopted a Resolution to approve the following
speed limits: 40 MPH for Leanna Swamp Road, 30 MPH for Old Lebanon Road, 40 MPH
for Hord Road and 45 MPH for Midland Fosterville Road. b.
The Board of Commissioners adopted a Resolution to approve the proposal
of Tennessee Department of Transportation for construction of a project
designated as No. 75006-1221-94, that is described as SR-10 (US-231) bridge and
approaches over Stones River (log mile 19.79) in Rutherford County. c.
The Board of Commissioners suspended the Rules to allow Mr. John Davis to
address the Board. d.
The Board of Commissioners adopted a Resolution to go on record as
willing to acquire real property necessary to follow and conform to the Long
Range Transportation Plan by negotiation or condemnation as required. e.
The Board of Commissioners suspended the Rules to allow for the next item
not on the Agenda. f.
The Board of Commissioners approved a Resolution to
reapportion the Sixth and Twenty-First County Legislative Districts so that a
portion of the existing Sixth District and voters contained therein shall be
reapportioned to the Twenty-First County Legislative District. 7.
STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE a.
