BOARD OF COMMISSIONERS

 

JUNE 15, 2000

 

A.        The regular session of the Rutherford County Board of Commissioners was called to order by Madam Chairman, Nancy R. Allen at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.

 

B.        Board of Commissioners Court Chaplain Trey Gooch, led the Invocation.

 

C.       Commissioner Jerry Baxter led the Pledge of Allegiance to the Flag of the United States of America.

 

D.       Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting.

 

E.        The Board of Commissioners adopted the May 11, 2000 Legislative Meeting Minutes as typed.

 

F.        RESOLUTIONS OF SYMPATHY

 

1.      The Board of Commissioners adopted a Resolution of Sympathy in memory of Donna Duckworth Smith.

2.      The Board of Commissioners adopted a Resolution of Sympathy in memory of James David Edgens.

3.      The Board of Commissioners adopted a Resolution of Sympathy in memory of Don Castleman.

 

G.       ELECTIONS & CONFIRMATIONS

 

1.      The Board of Commissioners approved the Notary Public-at-Large Applicant List as mailed out by the Office of the Rutherford County Clerk.

2.      The Board of Commissioners was informed of vacancies on the Linebaugh Library Board.

3.      The Board of Commissioners was informed of two vacancies on the Community Care Board.

4.      The Board of Commissioners appointed Ricky E. Reynolds as Constable for the first District.

5.      The Board of Commissioners confirmed the appointment of Barb Ford to the Cultural Arts Commission.

6.      The Board of Commissioners appointed Lisa Brewer and Liza Turner to serve as Judicial Commissioners for terms not to exceed four years and such terms to conclude and terminate if and when the terms are concluded or the service with Rutherford County is terminated.

 

H.   UNFINISHED BUSINESS

 

       1.  No Report.

 

 I.    TRENT SMITH – REPORT ON LANDFILL

 

Trent B. Smith addressed the Board of Commissioners regarding the current status of the Rutherford County Landfill closure and a brief summary of the history of the closure.

 

J.    PUBLIC HEARINGS-6:30 P.M.

             

  1. The Board of Commissioners held a Public Hearing on the request from Nashville Kennel Club to rezone property located at 2451 Shoemaker Road, Eagleville from Residential-20 to Agricultural Services with a Conditional Use Permit to allow 0752 – Animal Specialty Services, except veterinary – showing of pets and other animals in the Agricultural Services Zone.   No one spoke for the request and Whorley Whitfield spoke against the request.  The Board of Commissioners then denied the request as recommended by the Rutherford County Planning Commission.
  2. The Board of Commissioners held a Public Hearing on the request from Georgina K. Lounds for a Conditional Use Permit to allow Services 7299-Miscellaneous Personal Services-Message Therapy Business in the Residential-20 zone.  Georgina K. Lounds spoke for the request and no one spoke against the request.  The Board of Commissioners then approved the request along with the conditions as recommended by the Rutherford County Planning Commission.
  3. The Board of Commissioners held a Public Hearing on the request from George Moody to rezone property located at 8190 Highway 99, Rockvale from Residential-20 to Manufacturing with a Conditional Use Permit to allow Manufacturing 2499-Miscellaneous Wood Products and 5113-Corrugated Products in the Manufacturing Zone. No one spoke for or against the request.  The Board of Commissioners then approved the request along with the conditions as recommended by the Rutherford County Planning Commission.

 

 

 

 

K.   REPORTS BY STANDING COMMITTEES

 

  1. PURCHASING COMMITTEE

 

a.      The Board of Commissioners adopted the Purchasing Committee Report as mailed out.

 

2.      BUDGET, FINANCE & INVESTMENT COMMITTEE

 

a.      The Board of Commissioners adopted a recommendation that the County Executive be authorized to execute a contract with William C. Beeler Company as the Third Party Administrator for Rutherford County’s Health Insurance Program as recommended by the Insurance Committee.

b.      The Board of Commissioners suspended the Rules to allow Mr. Bob Shupe to address the Board.

c.      The Board of Commissioners adopted a recommendation that the County Executive be authorized to renew the self-funded worker’s compensation program through Brentwood Services and the Murfreesboro Insurance Agency with the reinsurance being moved from Frontier to Safety National.

d.      The Board of Commissioners adopted the General Fund Budget Amendments with regard to the following:

4.     Environmental

5.     Property Assessor

6.     Health Department

7.     Emergency Medical Services

8.     Emergency Services

9.     Correctional Work Center

10. Sheriff’s Department

11. Payment to Cities

e.      The Board of Commissioners adopted the Solid Waste/Sanitation Fund Budget Amendments with regard to the following:

1.     Revenue Adjustments

2.     Other Waste Collection

3.     Litter Program

f.        The Board of Commissioners adopted the Industrial/Economic Development Fund Amendments regarding Revenue Adjustments.

g.      The Board of Commissioners adopted the Local Purpose Tax Fund Budget Amendments regarding Revenue Adjustments.

h.      The Board of Commissioners adopted the Drug Control Fund Amendments regarding Revenue Adjustments.

i.        The Board of Commissioners adopted the Road & Bridge Fund Budget Amendments regarding Revenue Adjustments.

j.         The Board of Commissioners adopted the Debt Service Fund Budget Amendments regarding Revenue Adjustments.

k.      The Board of Commissioners adopted a Resolution to recommend that One Hundred Fifty Thousand Dollars ($150,000.00) be appropriated from the Stones River Middle School Project to provide preliminary funding for Blackman Middle School, Rock Springs Middle School and Siegel High School.

l.         The Board of Commissioners adopted a Resolution to express its intent to appropriate Eighty-Seven Thousand Seven Hundred Dollars ($87,700.00) for televising County Commission Meetings.

 

3.      HEALTH & EDUCATION COMMITTEE

 

a.      No Report.

 

4.      PROPERTY MANAGEMENT COMMITTEE

 

a.      The Board of Commissioners adopted a Resolution to approve the Lease Agreement with Ricky Parker, Carol Parker and Betty Tittle for property generally known as 3001 Guy James, Lascassas, Tennessee.

b.      The Board of Commissioners adopted a Resolution to approve a Lease Agreement between Rutherford County, Tennessee and Will H. Parker for property located in the 9th Civil District of Rutherford County, Tennessee.

c.      The Board of Commissioners adopted a Resolution to approve the Lease Agreement between Rutherford County, Tennessee and James Campbell for property located in the 9th Civil District of Rutherford County, Tennessee.

d.      The Board of Commissioners adopted a Resolution to approve the form regarding Use of Facilities of Non-County Related Groups.

 

      5.  PUBLIC SAFETY COMMITTEE

 

a.      The Board of Commissioners discussed in length the request from the Animal Services Board for a new facility in the Blackman area.  After discussion, the Board of Commissioners voted to send the request to build the facility back to the Public Safety Committee.

 

6.   PUBLIC WORKS & PLANNING COMMITTEE

 

a.      The Board of Commissioners adopted a Resolution that the appropriate officials on behalf of Rutherford County be authorized to execute the contract with the Department of Transportation, State of Tennessee for litter removal activities on State Highways within Rutherford County effective July 1, 2000 through July 1, 2001.

 

7.      STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE

 

a.      The Board of Commissioners adopted a Resolution that the appropriate officials on behalf of Rutherford County execute the agreement with Thomas A. Brown and Guaranty Agreement with the State of Tennessee, Board of Licensing Contractors, for contracting and construction activities of Thomas A. Brown for Rutherford County, Tennessee.

b.      The Board of Commissioners adopted a Resolution to approve the imposition of an additional ten dollars ($10.00) in Litigation Tax pursuant to amendment to T.C.A. 67-4-601.

c.      The Board of Commissioners was presented a Resolution to have a regular County Commission meeting in July.  This motion failed.

d.      The Board of Commissioners suspended the Rules for the next item not on the Agenda.

e.      The Board of Commissioners adopted a Resolution approving the Act relative to the Rutherford County Development Tax, Private Chapter No. 149, House Bill No. 3314, Private Acts of 2000 by two-thirds majority.  

 

There being no further business, Madam Chairman, Nancy R. Allen adjourned the Rutherford County Board of Commissioners Legislative Meeting at 7:55 p.m.
