JUNE 13, 2002

 

A.        The regular session of the Rutherford County Board of Commissioners was called to order by Madam Chairman, Nancy R. Allen on Thursday, June 13, 2002 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.

 

B.        Board of Commissioners Court Chaplain Trey Gooch, led the Invocation.

 

C.       Kevin Youse led the Pledge of Allegiance to the Flag of the United States of America.

 

D.       Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting.

 

E.        The May 16, 2002 Legislative Meeting Minutes were adopted as typed.

 

F.   RESOLUTIONS OF SYMPATHY

 

1.      The Resolution of Sympathy in memory of William H. Butler, Sr. was adopted.

2.      The Resolution of Sympathy in memory of Will Drew, Sr. was adopted.

 

G.  RESOLUTION OF RECOGNITION

 

       1.   The Resolution of Recognition in honor of the 2002 LaVergne High School

              Wolverines Baseball Team was adopted.

  

H.       RESOLUTION OF APPRECIATION    

 

1.    The Resolution of Appreciation in honor of Fred and Anathia Beneby was

        adopted.

 

I.    PUBLIC COMMENTS

 

1.      Kevin Youse spoke with regard to the POW/MIA Flag.

2.      W. A. Sartin spoke with regard to the POW/MIA Flag.

3.      Alex Meachom spoke with regard to County taxes.

4.      Thomas L. Adams spoke with regard to POW/MIA Flag.

5.      June Chew spoke with regard to the County Budget.

 

J.      ELECTIONS & CONFIRMATIONS

 

1.      The Notary Public-at-Large Applications as presented by the Office of the Rutherford County Clerk were approved.

2.      A vacancy was announced on the Highland Rim Regional Library Board.

3.      Two vacancies were announced on Community Care.

4.      Five vacancies were announced on the Audit Committee consisting of three Commissioners and two lay persons with financial auditing and budget experience

5.      Ernest Burgess, Nell Blankenship and Betsy Waldron were appointed to serve on the Linebaugh Library Board.

6.      Dorothy Norris, John M. Key, DVM, James Milton Beckman, James W. Garner, Jr., M.D., Ronald T. Wright, and
 Dennis C. Carter, M.D. were appointed to serve on the Board of Health.

7.      Steve Sandefur was appointed to serve as Employee Representative on the Insurance Committee.

 

K.     UNFINISHED BUSINESS

 

   1.  No Report.

 

L.   PUBLIC HEARINGS-6:30 P.M.

             

  1. The request from Tim Newcomb and Geri R. Spry to rezone property located at 7212 Old Nashville Highway from R-15 to a Conditional use permit for General Automotive Repair Shops was approved along with conditions as recommended by the Rutherford County Planning Commission.
  2. The request from Allen Gambill, Jr. to amend the Conditional Use Permit No. A-556 for property located at 9730 Shelbyville Pike requested removal from original approval granted on February 14, 2002: 5084 – retail sales of Industrial trucks and equipment to the requested amendment: retail sales of farm equipment and machinery repair shop and allow twenty-five tractors and four-hundred other pieces of equipment be displayed for sale was approved along with conditions as recommended by the Rutherford County Planning Commission.
  3. The request from Frank Bauer to rezone property located at 5630 Lebanon Pike from R-15 to a Conditional Use Permit for Plumbing Contracting Services was approved along with conditions as recommended by the Rutherford County Planning Commission.
  4. The request from Gerald R. Edsell to amend the Conditional Use Permit No. A-178 for property located at the corner of Shelbyville Pike and Oakmeadows Drive from Commercial to the requested amendment: Retail sale of pools and spas, retail sale of pool parts and accessories and retail sale of gazebos, storage sheds, and utility trailers was approved along with conditions as recommended by the Rutherford County Planning Commission.
  5. The request from Kaviphone Pat Vanisouvong to amend the Conditional Use Permit No. A-504 for property located at 3904 Veals Road from retail and wholesale trade to the requested amendment: up to five employees to scavenge parts from vehicles and increase the number of vehicles allowed on site to twenty was denied as recommended by the Rutherford County Planning Commission.

h.      A recommendation to enter into an agreement to construct a Visitors Center on the Agriculture Extension Center Property located on John Rice Boulevard was adopted.

i.        A recommendation to approve the United Health Care as the Reinsurance Carrier through the William C. Beeler Company for employee’s health insurance plan effective July 1, 2002 was adopted.

j.         A recommendation to approve Celtic Life as the Transplant Carrier through the William C. Beeler Company for the employee’s health plan was adopted.

k.      A recommendation to amend the Self-Funded Health Insurance Plan document with regard to Health Maintenance Organizations was adopted.

l.         A recommendation authorizing the County Executive to execute Amendment Two to Contract HDT000001 between Rutherford County and the State of Tennessee, Department of Children’s Services was adopted.

m.    A recommendation to provide one-half the cost to pay a consultant to determine cost of Linebaugh Library Roof repair was adopted.

 

3.      HEALTH & EDUCATION COMMITTEE

 

a.      No Report.

 

4.      PROPERTY MANAGEMENT COMMITTEE

 

a.      No Report.

 

      5.  PUBLIC SAFETY COMMITTEE

 

a.      A resolution authorizing the Juvenile Detention Department to apply for the National School Lunch, School breakfast, special milk and commodity school program was adopted. 

 

6.   PUBLIC WORKS & PLANNING COMMITTEE

 

a.      A resolution authorizing the closing of Blansett Street and conveying the property to the National Park Service was adopted.

b.      A resolution authorizing the County Executive to apply on behalf of Rutherford County for a litter and trash collecting grant from the Tennessee Department of Transportation was adopted.

c.      A resolution approving a contract to allow installation and maintenance of a school speed limit flashing beacon at State Route 102 at Smyrna High School was adopted.

d.      A resolution authorizing the appropriate officials for and on behalf of Rutherford County to enter into and execute the contract with the Department of Transportation, State of Tennessee for litter removal activities on State highway within Rutherford County was adopted.

 

7.      STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE

 

a.      A resolution regarding the POW/MIA flag be flown under the American flag at County-owned buildings on National POW/MIA Recognition day, Armed Forces Day, Memorial Day, Flag Day, Independence Day and Veterans Day was offered but later amended.  An amendment to the motion to fly the flag under the American flag daily at County-owned buildings was approved.  The original motion as amended was adopted.

 

 

     8.   ANY OTHER BUSINESS

 

a.   Commissioner David Gammon commented on the Rutherford County school cafeteria program and asked the
      Health and Education Committee to look into the program.             

           

There being no further business, Madam Chairman, Nancy R. Allen adjourned the Rutherford County Board of Commissioners Legislative Meeting at 7:44 p.m.
