LEGISLATIVE DIGEST OF THE RUTHERFORD COUNTY BOARD OF COMMISSIONERS MAY 16, 2002
A. The regular session of the Rutherford County Board of Commissioners was called to order by Madam Chairman, Nancy R. Allen on Thursday, May 16, 2002 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee. B. Rutherford County Planning Director John Davis led the Invocation. C. Commissioner Joyce Ealy led the Pledge of Allegiance to the Flag of the United States of America. D. Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting. E. The April 11, 2002 Legislative Meeting Minutes were adopted as typed.
F. RESOLUTIONS OF SYMPATHY 1. The Resolution of Sympathy in memory of Asa Davis, Jr. was adopted. 2. The Resolution of Sympathy in memory of Walter King Hoover was adopted.
G. RESOLUTIONS OF RECOGNITION
1. The Resolution of Recognition in honor of Rutherford County Health Department Director, Tela Bayless and employees was adopted.
H. PUBLIC COMMENTS 1. No one spoke
I. ELECTIONS & CONFIRMATIONS 1. The Notary Public-at-Large Applications as presented by the Office of the Rutherford County Clerk were adopted.

Bill Jones, Sheriff Truman Jones, and John Hood were appointed to serve
on the Emergency Communications 3. Grant Kelley was appointed to serve on the Central Tennessee Solid Waste Board. 4. Three vacancies were announced on the Linebaugh Library Board. 5. Six vacancies were announced on the Board of Health.

L. REPORTS BY STANDING COMMITTEES
a. The Purchasing Committee Report was adopted as mailed out.
2. BUDGET, FINANCE & INVESTMENT COMMITTEE a. The General Fund Budget Amendments with regard to the following were adopted: 1. Board of Equalization

Employee & Dependent Insurance for Information Technology, General
Sessions Court, and Animal 3. Sheriff’s Department b. A recommendation to amend the Solid Waste/Sanitation Fund Budget was adopted. c. A recommendation to amend the Local Purpose Tax Fund Budget was adopted. d. A recommendation to amend the General Purpose School Fund Budget was adopted . e. A resolution to enter into a Bi-Party Agreement between Rutherford County and the Public Building Authority to begin a drainage study of the drainage basin of the Lower East Fork and Middle East Fork of the Stones River was adopted. f. The rules were suspended to allow Planning Director, John Davis, to address the Board and to answer questions with regard to the Bi-Party Agreement. g. A recommendation to approve an initial resolution authorizing funding for the LaVergne Library was adopted. h. A recommendation to approve a bond resolution authorizing funding for the LaVergne Library was adopted. i. A recommendation that the County Executive begin the process of hiring an outside independent auditor to conduct a comprehensive audit of the County to include financial, compliance, efficiency and performance reviews of all county departments was adopted but later amended.
3. HEALTH & EDUCATION COMMITTEE a. No Report
4. PROPERTY MANAGEMENT COMMITTEE a. A resolution to request the Public Building Authority to proceed with all of the necessary steps required for the rezoning of the Agriculture Center property to Planned Commercial was adopted.
5. PUBLIC SAFETY COMMITTEE a. No Report
6. PUBLIC WORKS & PLANNING COMMITTEE a. A resolution authorizing the appropriate officials to execute and enter into for and on behalf of Rutherford County the utility easement for property located in the ninth civil district, with Consolidated Utility District of Rutherford County was adopted.
7. STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE
a.
A resolution supporting a Private Act to authorize the Rutherford County
Highway Commission and
b.
The rules were suspended to allow Rutherford County Planning Director
John Davis to address the Board c. A resolution to rescind the June 17, 1999 resolution entitled “Displaying the Ten Commandments” and the March 14, 2002 resolution as amended requiring the County Executive to post the Ten Commandments in the Courthouse on the 35th day and requiring the Steering Committee to make recommendations regarding other historical documents to be displayed in the Courthouse was adopted. The original motion was amended to rescind the April resolution regarding the Ten Commandments but the motion failed.
8. ANY OTHER BUSINESS a. Rutherford County Finance Director Paul Long announced that three grant proposals from the Rutherford County Sheriff’s Department have been applied for and were authorized. b. Commissioner David Gammon announced that the Smyrna Motor Vehicle Office will be opening on Monday, May 20, 2002 and that the Tri-Star Health System in Smyrna will be having a ground breaking ceremony on Friday, May 17, 2002 at 10:00 a.m. and the Rutherford County Commissioners are invited to attend.
There being no further business, Madam Chairman, Nancy R. Allen adjourned the Rutherford County Board of Commissioners Legislative Meeting at 7:40 p.m.
