BOARD OF COMMISSIONERS

 

MAY 11, 2000

 

A.        The regular session of the Rutherford County Board of Commissioners was called to order by Madam Chairman, Nancy R. Allen at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.

B.        Board of Commissioners Court Chaplain Trey Gooch, led the Invocation.

C.       Commissioner Tina Jones led the Pledge of Allegiance to the Flag of the United States of America.

D.       Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting.

E.        The Board of Commissioners adopted the April 13, 2000 Legislative Meeting Minutes as typed.

 

F.    RESOLUTIONS OF SYMPATHY

1.         The Board of Commissioners adopted a Resolution of Sympathy in memory of Leonard Zachery.

2.    The Board of Commissioners adopted a Resolution of Sympathy in memory of Charles A. Ransom.

G.   ELECTIONS & CONFIRMATIONS

1.      The Board of Commissioners approved the Notary Public-at-Large Applicant List as mailed out by the Office of the Rutherford County Clerk.

2.      The Board of Commissioners appointed Steve Smith, David Baxter, and Mike Nunley to the Emergency Communications District Board.

3.      The Board of Commissioners was informed of vacancies on the Linebaugh Library Board.

4.      The Board of Commissioners was informed of the District #1 Constable Position.

5.      The Board of Commissioners confirmed the appointment of Helene Colvin to the Cultural Arts Commission.

 

H.   UNFINISHED BUSINESS

1.      No Report.

 

I.   PUBLIC HEARINGS-6:30 P.M.

  1. The Board of Commissioners held a Public Hearing on the request from Donald L. Bruce to rezone property located at 3955 Old Nashville Highway, Murfreesboro, from R-20 to Transportation with a Conditional Use Permit to allow 4225 - Mini-Warehouses.  Donald L. Bruce spoke for the request and no one spoke against the request. The Board of Commissioners then approved the request along with the conditions as recommended by the Rutherford County Planning Commission.
  2. The Board of Commissioners held a Public Hearing on the request from Donald L. Bruce for a Conditional Use Permit for property located at 6640 Shores Road, Murfreesboro, to allow Retail Trade 527 – Retail Sales and Repair of Recreational Vehicles, and Outdoor Advertising Services – Billboards in the Retail and Wholesale Trade Zone.   Donald L. Bruce spoke for the request and no one spoke against the request.  The Board of Commissioners then denied the request as recommended by the Rutherford County Planning Commission.
  3. The Board of Commissioners held a Public Hearing on the request from Jennifer D. Roberson for a Conditional Use Permit to allow Agricultural Services 0752 – Animal Specialty Services – Training and Boarding Horses in the R-20 Zone.  No one spoke for or against the request.  The Board of Commissioners then approved the request along with the conditions as recommended by the Rutherford County Planning Commission.

 

J.   REPORTS BY STANDING COMMITTEES

  1. PURCHASING COMMITTEE

a.      The Board of Commissioners adopted the Purchasing Committee Report as mailed out.

 

2.      BUDGET, FINANCE & INVESTMENT COMMITTEE

a.      The Board of Commissioners approved the General Fund Budget Amendments with regard to the following:

1.     Circuit Judge

2.     Other Public Health & Welfare (Medical Examiner)

3.     Sheriff’s Department

b.      The Board of Commissioners adopted the General Purpose School Budget Amendments.

c.      The Board of Commissioners adopted the recommendation that the County Executive be authorized to execute Grant Agreement No. Z-00-098493-00 between the State of Tennessee, Department of Military Tennessee Emergency Management Agency and Rutherford County in the amount of Seventeen Thousand Two Hundred Twenty Dollars ($17,220.00).

d.      The Board of Commissioners adopted the Recommendation to increase health insurance premiums. The change to Rutherford County’s contribution to the Employee Insurance Fund would be effective July 1, 2000 and the change of the Employee’s contribution to the Employee Insurance Fund would be effective January 1, 2001.

 

3.     HEALTH & EDUCATION COMMITTEE

a.      The Board of Commissioners was presented a Resolution authorizing the County Executive to execute on behalf of Rutherford County a lease agreement with the City of Murfreesboro for a new Rutherford County Health Department upon land owned by the City of Murfreesboro.  No vote was taken at this time.

b.      A motion was made that the City of Murfreesboro be responsible for the demolition of the Crichlow building.  This motion failed.

c.      The Board of Commissioners then adopted the original Resolution as presented.

 

4.      PROPERTY MANAGEMENT COMMITTEE

a.      The Board of Commissioners adopted a Resolution authorizing the appropriate officials on behalf of Rutherford County to enter into and execute the Lease Agreement with the Eagleville Lions Club.

b.      The Board of Commissioners adopted a Resolution to allow Omega Ministries to utilize a portion of County owned property on Weakley Road for the purpose of holding a tent revival on June 1, 2, and 3, 2000.

 

      5.   PUBLIC SAFETY COMMITTEE

a.      No Report.

 

6.   PUBLIC WORKS & PLANNING COMMITTEE

a.      The Board of Commissioners adopted a Resolution authorizing the County Executive on behalf of Rutherford County to apply for a litter and trash collecting grant from the Tennessee Department of Transportation.

 

7.    STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE

a.      The Board of Commissioners was presented a Resolution as the Conflict of Interests Policy for Rutherford County pursuant to Tennessee Code Annotated Sections 12-4-101, 54-7-203.  This motion was withdrawn.

b.      The following amendment to the Resolution was presented:

“That any person doing business with the County and is related to a County Commissioner by being their wife, husband, sister, brother, daughter or son be considered an indirect conflict of interest.”      

                This motion was withdrawn.

c.      The Board of Commissioners then deferred this Resolution to a later date.

 

 

There being no further business, Madam Chairman, Nancy R. Allen adjourned the Rutherford County Board of Commissioners Legislative Meeting at 7:20 p.m.
