BOARD OF COMMISSIONERS

 

APRIL 12, 2001

 

A.        The regular session of the Rutherford County Board of Commissioners was called to order by Madam Chairman, Nancy R. Allen at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.

 

B.        Board of Commissioners Court Chaplain Paul Johnson, led the Invocation.

 

C.       Commissioner Carol Cook led the Pledge of Allegiance to the Flag of the United States of America.

 

D.       Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting.

 

E.        The Board of Commissioners adopted the March 15, 2001 Legislative Meeting Minutes as typed with the following correction to Amendment #3 to the Resolution regarding Rutherford County v. Town of Smyrna:

 

“If any settlement is made with the Town of Smyrna before a Court hearing, the Town of Smyrna be made to pay the attorney’s of the County and that said attorney’s fees not be taken out of any settlement money.  Otherwise, the County shall pay its attorney’s fees out of any recovery received and decided through Court proceedings.”

 

F.        RESOLUTIONS OF SYMPATHY:

 

1.          The Board of Commissioners adopted a Resolution of Sympathy in memory of Dorris William Lorance.

2.          The Board of Commissioners adopted a Resolution of Sympathy in memory of J. Milton Irvin.

 

G.   PUBLIC COMMENTS

 

1.      Principal Jerry Hesson of Roy Waldron School addressed the Board of Commissioners regarding the heating and cooling for Roy Waldron School.

H.        ELECTIONS & CONFIRMATIONS

 

1.      The Board of Commissioners approved the Notary Public-at-Large Applicant List as mailed out by the Office of the Rutherford County Clerk with the addition of Kayce L. Vaughan and Floyd M. Wilson.

2.      The Board of Commissioners appointed Maile Lynn Alford to serve as Judicial Commissioner for a term not to exceed four years and such term to conclude and terminate if and when the term is concluded or the service with Rutherford County is terminated.

3.      The Board of Commissioners was informed of three vacancies on the Emergency Communications District Board.

 

I.   UNFINISHED BUSINESS

      1.  No Report. 

J.    MONTHLY & QUARTERLY REPORTS

 

1.      The Board of Commissioners adopted the Monthly and Quarterly Reports, with the exception of the Jail Report and the Purchasing Committee Report, as mailed out.

 

K.   PLANNING AND ZONING COMMISSION

             

  1. The Board of Commissioners held a Public Hearing on the request from Golf for Everyone, L.L.C. regarding property located at 14626 Mount Pleasant Road for an amendment to Conditional Use Permit Number A-516 to add tracts “A” and “B” to the Conditional Use Permit and amend the parking condition. No one spoke for or against the request.  The Board of Commissioners then approved the request along with the conditions as recommended by the Rutherford County Planning Commission.
  2. The Board of Commissioners held a Public Hearing on an amendment to the Rutherford County Zoning Resolution regarding Article VII, Section 7.03: Child Care, Family Day Care and Group Day Care Homes.  One person spoke for the amendment and no one spoke against the amendment.  The Board of Commissioners then approved the amendment as recommended by the Rutherford County Planning Commission.
  3. The Board of Commissioners held a Public Hearing on an amendment to the Rutherford County Zoning Resolution regarding corner lots used for single family dwellings.  No one spoke for or against the request.  The Board of Commissioners then approved the amendment as recommended by the Rutherford County Planning Commission.
  4. The Board of Commissioners held a Public Hearing on an amendment to the Rutherford County Zoning Resolution regarding Article IXX, General Flood Damage Prevention for all Hazard Districts, Section 19.03 Part K.  No one spoke for or against the amendment.  The Board of Commissioners then approved the amendment as recommended by the Rutherford County Planning Commission.
  5. The Board of Commissioners suspended the Rules to allow for the next item not on the Agenda.  The Board of Commissioners was presented a Resolution that the Rutherford County Board of Commissioners go on record as being opposed to any extensions of city sewer services into the Rural Boundary of Rutherford County as identified on the Urban Growth Boundary Plan of Rutherford County. No vote was taken at this time.  The Board of Commissioners then suspended the Rules to allow anyone wishing to speak on this motion to address the Board limiting the time to three minutes. One person spoke regarding this issue.  The Board of Commissioners then adopted a motion to deny the Resolution.   The Board of Commissioners then adopted a motion to request the Attorney General of the State of Tennessee to determine the legality of the expansion of city sewer services outside of the Urban Growth Boundary.

 

L.  REPORTS BY STANDING COMMITTEES

 

  1. PURCHASING COMMITTEE

 

a.      The Board of Commissioners adopted the Purchasing Committee
  Report as mailed out.

 

2.      BUDGET, FINANCE & INVESTMENT COMMITTEE

 

a.      The Board of Commissioners approved the General Fund Budget
  Amendments with regard to the following:

1.     Property Assessor

2.     Building Codes

3.     Official’s Salaries & Benefits

4.     Sheriff’s Department

b.      The Board of Commissioners adopted the Road & Bridge Fund Budget
  Amendment.

c.      The Board of Commissioners was presented the General Purpose
  School Fund Budget Amendments.  Prior to voting Commissioner Joyce
  J. Ealy stated the following conflict of interest statement:

“Because I am an employee of Rutherford County, I have a conflict of interest in the proposal about to be voted.  However, I declare that my argument and my vote answer only to my conscience and to my obligation to my constituents and the citizens this body represents.”

The Board of Commissioners then adopted the General Purpose    
School Fund Budget Amendments.

d.      The Board of Commissioners adopted a Resolution for the approval of a
  Capital Outlay Note Resolution in the amount of Three Million Fifty-Five
  Thousand Dollars ($3,055,000.00) for the purpose of providing funds for
  HVAC mechanical systems for David Youree and Roy Waldron Schools.
 
The Resolution further states the General Purpose School Fund be
 amended to provide preliminary short-term funding in the amount of One
 Million Two Hundred Eighty-Five Thousand Dollars ($1,285,000.00).

e.      The Board of Commissioners adopted a recommendation to provide
  funding from the General Purpose School Fund in the amount of One
  Hundred Fifty Thousand Dollars ($150,000.00) to replace roofs at Central
  Middle, Christiana and Smyrna Primary Schools.

 

3.      HEALTH & EDUCATION COMMITTEE

 

a.      No Report.

 

4.      PROPERTY MANAGEMENT COMMITTEE

 

a.      No Report.

 

      5.  PUBLIC SAFETY COMMITTEE

 

a.      No Report.

 

6.   PUBLIC WORKS & PLANNING COMMITTEE

 

a.      The Board of Commissioners adopted a Resolution that the maximum speed limit shall be 40 miles per hour for all motor vehicles travelling on Florence Road.

 

  1.  STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE

 

a.      The Board of Commissioners adopted a Resolution to approve the Rutherford County Employee Handbook.

b.      The Board of Commissioners adopted a Resolution to evidence its consent to the right of the City of Murfreesboro to have a contract with the Department of Veterans Affairs, United States of America to provide fire suppression services which shall be the sole duty and obligation of the City and V.A. according to such terms and conditions as said contract may provide.

c.      The Board of Commissioners adopted a Resolution to Approve a Lease Agreement between the Rutherford County Board of Education and the City of Murfreesboro.  Said Lease Agreement is for a small portion of property located on the Central Middle School Campus adjacent to East Lytle Street for use as a helicopter landing pad for the emergency airlift of sick and injured people to Middle Tennessee Medical Center. 

 

      8.  ANY OTHER BUSINESS

1.        The Board of Commissioners adopted a motion that the Resolution regarding the purchase of 45 acres, located on John Rice Boulevard, Murfreesboro, shall be modified to include that the general warranty deed for the purchase of the property shall restrict the use of the property to agricultural related services and facilities, including but not limited to: an Agricultural Center, Farmers’ Market, 4-H training facility, crop testing, botanical gardens and animal services for a period of fifty (50) years.

 

 

There being no further business, Madam Chairman, Nancy R. Allen adjourned the Rutherford County Board of Commissioners Legislative Meeting at 7:49 p.m.
