15, 2001 A. The regular session of the Rutherford County Board of Commissioners was called to order by Madam Chairman, Nancy R. Allen at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee. B.
Board of
Commissioners Court Chaplain Paul Johnson, led the Invocation. C.
Dustin Bowen
led the Pledge of Allegiance to the Flag of the United States of America. D.
Twenty
Rutherford County Board of Commissioners were present for the Legislative
Meeting. E.
The Board of
Commissioners adopted the January 11, 2001 Legislative Meeting Minutes as typed. F. RESOLUTIONS OF SYMPATHY 1.
The Board of
Commissioners adopted a Resolution of Sympathy in memory of Judges James Weldon
Buckner. 2.
The Board of
Commissioners adopted a Resolution of Sympathy in memory of Howard Hooper Penuel,
Sr. G.
PUBLIC COMMENTS
1.
Mr. David
Limbaugh addressed the Board of Commissioners regarding a Rutherford Metro
Government. Mr. Limbaugh also
thanked the Board of Commissioners for the opportunity to speak. H.
ELECTIONS & CONFIRMATIONS 1.
The Board of
Commissioners was presented a motion to approve the Notary Public-at-Large
Applicant List as mailed out by the Office of the Rutherford County Clerk.
No vote was taken at this time. The
Board of Commissioners approved an amendment to add Carl David Summar and
Shirley Putnam to the Notary Public-at-Large Applicant List.
The Board of Commissioners then approved the original motion. 2.
The Board of
Commissioners appointed Jim Estes and Dan Mitchell to serve on the Conservation
Board for a five-year term. 3.
The Board of
Commissioners appointed Grant Kelley to fill the Commissioner vacancy on the
Insurance Committee. 4.
The Board of
Commissioners confirmed the appointment of Jack Weatherford to the Smyrna
Rutherford County Airport Authority. I.

BY STANDING COMMITTEES
a. The Board of Commissioners adopted the Purchasing Committee Report as mailed out. 2. BUDGET, FINANCE & INVESTMENT COMMITTEE a. The Board of Commissioners approved the General Fund Budget Amendments with regard to the following: 1. County Clerk 2. Health Department (2) 3. Ambulance Service 4. Juvenile Detention(2) 5. Sheriff’s Department 6. Miscellaneous b. The Board of Commissioners adopted the Solid Waste/Sanitation Fund Budget Amendment. c. The Board of Commissioners adopted the Road & Bridge Fund Budget Amendments. d. The Board of Commissioners adopted the Recommendation to Renegotiate Renewal of Health Insurance with William C. Beeler. e. The Board of Commissioners adopted a Resolution to approve the concept of allowing the Rutherford County Highway Department to utilize the Road & Bridge Fund ending balance to hire an engineer for the purpose of designing and constructing a new Highway Department facility. f. The Board of Commissioners approved Surety Bond No. DRS 1015457 for Michael Hammond as Third District Constable of Rutherford County with the term to expire August 31, 2002. 3. 5. PUBLIC SAFETY
COMMITTEE a. The Board of Commissioners adopted a Resolution that if awarded the 2001 Bulletproof Vest Partnership grant that the County Executive is authorized to accept said grant for and on behalf of Rutherford County. 6. PUBLIC WORKS & PLANNING COMMITTEE a.
The Board of
Commissioners adopted a Resolution that the maximum speed limit shall be 40
miles per hour for all motor driven vehicles travelling on S. Rucker Road and
Shacklett Road. b.
The Board of
Commissioners adopted a Resolution that the Rutherford County Highway Department
relocate its operations to County owned land commonly referred to as the
Samsonite ballfield property and convey its current site on Highway 231 to
Rutherford County. c.
The Board of
Commissioners adopted a Resolution to approve the proposal between Rutherford
County, Tennessee and the State of Tennessee Department of Transportation for
construction of Project No. 2833, Agreement No. 2000657, that is described as
construction of left and right turn lanes at log mile 11.0 at the Wilson School
entrance on State Route 266. 7. STEERING,
LEGISLATIVE, & GOVERNMENTAL COMMITTEE a.
The Board of
Commissioners adopted a Resolution to support a Resolution from Obion County
Requesting Legislative Amendment of Tennessee Code Annotated 65-12-108(1) which
requires a railroad crossing sign on every public road crossed by a railroad. b.
The Board of
Commissioners adopted a Resolution to approve amendment to the Capital Projects
Funding Guidelines. c.
The Board of
Commissioners adopted a Resolution to urge the General Assembly to enact
Legislation to authorize a Local Option Realty Transfer Tax in order to provide
needed fiscal relief to county governments.
8. ANY OTHER BUSINESS a.
The Board of
Commissioners was presented a motion to send a Resolution to the State
Legislators and the Tennessee County Services Association with regard to the
citizens of Rutherford County and the Rutherford County Board of Commissioners
being opposed to the State Income Tax. No
vote was taken at this time. An
amendment to send the issue back to the Steering Committee for further
consideration failed. After
discussion the original motion was approved. b.
The Board of
Commissioners was presented a motion to send a motion to our State Legislators
that Rutherford County is against the Lottery.
This motion failed. There
being no further business, Madam Chairman, Nancy R. Allen adjourned the
