A. Madam Chairman Nancy Allen called the regular session of the Rutherford County Board of Commissioners to order on Thursday, June 26, 2003 at 9:00 a.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.
B. Commission Court Chaplain, Trey Gooch led the Invocation.
C. Alan Miller led the Pledge of Allegiance to the Flag of the United States of America.
D. Twenty Rutherford County Board of Commissioners were present for the Legislative Meeting.
E. The June 12, 2003 Legislative Meeting Minutes were adopted as typed.
F. RESOLUTION OF APPRECIATION
1. The Resolution of appreciation in honor of The Holland Group was adopted.
G. PUBLIC COMMENTS
1. Kay Morrow spoke with regard to a Public Works Department. 2. Richard Baines spoke with regard to a Public Works Department. 3. Tammy Baskette spoke with regard to a Public Works Department.
H. ELECTIONS & CONFIRMATIONS
1. The Notary Public-at-Large Applications were not presented at this meeting. 2. Two vacancies were filled on the Community Care Board. 3. Two vacancies were filled on the Industrial Development Board and Heath, Education and Facilities Board.

a. The purchasing committee report as mailed out was adopted.
a. A resolution approving the renewals of property, casualty, crime, boiler insurance and worker’s compensation insurance was brought up. The rules were suspended to allow Bob Shupe to address the Board. After discussion, the original resolution was adopted. b. A resolution approving the 2002 – 2003 local purpose tax fund budget amendment was adopted. c. A resolution to amend the 2002 – 2003 general purpose school fund budget was adopted. d. A resolution approving a contract agreement with MicroVote General Corporation for purchase of voting machines was adopted. e. A resolution approving a contract with the City of Murfreesboro to improve Florence Road from Manson Pike to Northwest Broad Street was brought up but later amended. An amendment made to the original motion that the County’s participation be set at $1,889,995.00 was adopted. After discussion, the original motion as amended was adopted. f. A resolution fixing the tax levy for Rutherford County for the fiscal year beginning July 1, 2003 was brought up but later amended. Amendment #1 to the original motion to add 1.5 cents to the property tax rate to fund $454,534.00 for personnel, benefits and supplies for a Public Works Department with an additional $515,000.00 to be funded from the Development Tax for equipment for the Public Works Department, and to also add an additional one cent to the property tax rate for the General Fund, with County Employees in the General Fund, Solid Waste fund and drug control fund receiving a 1-step pay increase, and with a 2 cent increase for the Board of Education that shall be used for employee raises, effective July 1, 2003. This will make the total increase to the property tax rate 29 cents for a combined property tax rate of $2.80 per $100 of assessed value was brought up but failed. Amendment #2 to the original motion to add 1.5 cents to the property tax rate to find $454,534.00 for personnel, benefits and supplies for a Public Works Department, with an additional $515,000.00 to be funded from the Development Tax for equipment for the Public Works Department was adopted. Amendment #3 that we put the step raises back in for county employees adding 1 cent in the General Fund, and also for raises in the Solid Waste fund and the Drug control fund, utilizing approximately $445,000.00 from year-end fund balance (for an additional 27 cents) was adopted. Amendment #4 that 2 cents be added to the general purpose school fund for employee raises, effective July 1, 2003 was adopted. The original motion as amended 4 times was adopted. g. A resolution approving the appropriations for the various funds, departments, institutions, offices and agencies of Rutherford County for the fiscal year beginning July 1, 2003 and ending June 30, 2004 (revised to reflect amendments to the Tax levy) was adopted. h. A resolution approving the funding for the Siegel Stadium was brought up. The rules were suspended to allow Kenny Nolan and Tim McLaughlin to address the Board. After discussion, the original motion was adopted. i. A resolution to approve a contract agreement with the State of Tennessee Department of Transportation regarding litter removal was adopted. j. A resolution approving a contract with MTSU Business & Economic Research Center for study regarding impact of continuing growth on revenues and services was adopted. k. A resolution approving a grant agreement with the State of Tennessee Commission on Children and Youth for the provision of State supplement funds to improve juvenile court services was adopted.

a. A resolution approving the Rutherford County Mounted Patrol to cut hay from any undeveloped portion of the Lane Agri-Park property was adopted. A resolution approving a storm drainage easement and temporary construction easement with the City of Murfreesboro for the Salem Highway area was adopted. c. A resolution to request the Christy Houston Foundation to amend the restrictions in Deed Book 495, page 810 to allow archives and other governmental purposes at the old health department property was adopted. d. A resolution to request the Christy Houston Foundation to waive in writing the restrictions in Deed book 495, page 810 that the property will be used exclusively for Health Care purposes to allow for parking for twelve months at the old health department parking lot was adopted. e. The rules were suspended to bring up an item that was not on the agenda regarding the Esther Lane Development. A motion to have the County Commission approve the release and covenant not to sue, subject to the approval of the Property Management Committee at its July meeting in consultation with the County Executive and County Attorney was adopted.
