THURSDAY, JUNE 12, 2003

 

A.        Chairman Pro-Tem Steve Sandlin called the regular session of the Rutherford County Board of Commissioners to order on Thursday, June 12, 2003 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.

 

B.        Commission Court Chaplain, Trey Gooch led the Invocation.

 

C.       Elaine Cawthorn led the Pledge of Allegiance to the Flag of the United States of America.

 

D.       Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting.

 

E.        The May 15, 2003 Legislative Meeting Minutes were adopted as typed.

 

F.        RESOLUTIONS OF SYMPATHY

 

1.         The Resolution of Sympathy in memory of William Thomas Gooch, Jr. was adopted.

2.         The Resolution of Sympathy in memory of Ofa Beatrice Spain Jones was adopted.

3.         The Resolution of Sympathy in memory of Thomas Edwin Williams was adopted.

 

G.       RESOLUTION OF RECOGNITION

 

1.      The Resolution of Recognition in honor of the Randolph Family Heritage was adopted.   

 

H.        PUBLIC COMMENTS

 

1.      Bob Gamper spoke with regard to the Siegel Stadium.

 

I.            ELECTIONS & CONFIRMATIONS

 

1.      The Notary Public-at-Large Applications, as presented by the Office of the Rutherford County Clerk, were approved.

2.      Two vacancies were filled on the Linebaugh Library Board.

3.      Two vacancies were announced on the Community Care Board.

4.      Two vacancies were announced on the Industrial Development Board and Heath, Education and Facilities Board.

5.      The appointment of Amy Anderson as Judicial Commissioner was confirmed.

6.      The removal of Jason Holcomb from the Board of Zoning Appeals was adopted.

7.      A vacancy on the Board of Zoning Appeals was announced.

 

J.    UNFINISHED BUSINESS

 

   1.  No Report.

 

K.    PUBLIC HEARINGS-6:30 P.M.

             

  1. No one spoke for or against at the Public Hearing held with regard to the request from M. L. Barrett.  The request to rezone property located at 3427 West Jefferson Pike from Residential-15 to with a Conditional Use Permit to allow an office for a fencing rental company and storage for a fencing contractor was denied as recommended by the Rutherford County Planning Commission.
  2. One person spoke for and no one spoke against at the Public Hearing held with regard to the request from Barbara and Terry Duvall.  The request to amend the Conditional Use Permit for the property located at 1444 West Jefferson Pike from Residential to requested amendment to increase the number of dogs allowed on site was approved along with conditions as recommended by the Rutherford County Planning Commission.
  3. No one spoke for or against at the Public Hearing held with regard to the request from Buddy Woodson, President Tennessee Valley Pioneer Power Association.  The rules were suspended to allow Mr. Woodson to address the Board.  The request to amend the Conditional Use Permit for the property located at 747 Chapel Hill Pike from Services to requested amendment to remove the requirement to buffer around the perimeter of the property in question was approved along with conditions as recommended by the Rutherford County Planning Commission.
  4. No one spoke for or against at the Public Hearing held with regard to the request from Margaret Eady.  The request to amend the Conditional Use Permit for the property located at 7778 Couchville Pike from Residential-15 to requested amendment to remove the requirement for the dedication of right-of-way to Couchville Pike was approved along with conditions as recommended by the Rutherford County Planning Commission.

              

L.  REPORTS BY STANDING COMMITTEES

 

  1. PURCHASING COMMITTEE

 

a.      The purchasing committee report as mailed out was adopted.

 

 

2.      BUDGET, FINANCE & INVESTMENT COMMITTEE

 

a.      A resolution approving Lisa A. Nolen as the Finance Director for Rutherford County, Tennessee was adopted.

b.      A resolution approving an Official Statutory Blanket Bond in the amount of One Hundred Thousand Dollars ($100,000.00) for Lisa Nolen, Finance Director.

c.      A recommendation to amend the General Fund with regard to the following was adopted:

1.      Revenue Adjustments

2.       Board of Equalization

3.      Property Assessor

4.      Ambulance Service (3)

5.      Sheriff’s Department (5)

6.      Building Codes

7.      Youth Services

8.      Animal Services

d.      A resolution approving the financing by the Health and Educational Facilities Board for the Tennessee Home Solutions Homes and Supports, Inc. was adopted.

e.      A resolution approving a grant agreement with the Tennessee Emergency Management Agency to provide pass thru funding to subsidize Emergency Management was adopted.

f.         A resolution approving a STOP Violence Against Women Grant Award was adopted.

g.      A resolution approving the Multi-year Edward Byrne Memorial Grant Award for the Drug Court was adopted.

h.      A resolution approving the Multi-year Edward Byrne Memorial Grant Award for the Sheriff’s Department was adopted.

i.        A resolution to amend the Solid Waste/Sanitation Fund Budget with regard to the following was adopted:

1.      Revenue Adjustments & Trustee’s Commission

2.      Convenience Centers

3.      Landfill Operations & Maintenance 

j.         A resolution to amend the Local Purpose Tax Fund Budget with regard to the following was adopted:

1.   Revenue Adjustments, Trustee’s Commission & Operating Transfers

2.   Correctional Work Center/Juvenile Detention Center Architect Fees

3.   Funding for Infrastructure costs for Agriculture Extension, Animal Services & Juvenile Courtroom

k.      A resolution to amend the Drug Control Fund regarding revenue adjustments and trustee’s commission was adopted.      

l.         A resolution to amend the Road & Bridge Fund regarding revenue adjustments was adopted.

m.    A resolution to amend the general purpose school fund was adopted.

n.      A resolution to request to designate funds for the purpose of purchasing the Horizon Attendance System or another system, if necessary, was adopted.

o.      A resolution to approve the release of funds for the Siegel Stadium was brought up.  The rules were suspended to allow Mr. Gill, Mr. McLaughlin, Mr. Nolan, Mr. Sandvig and Mr. Jordan to address the Board.  An amendment to delay releasing the funds for Siegel Stadium until the June 26, 2003 meeting, after the tax rate is set was adopted.  The original motion as amended was adopted.

p.      A resolution to amend the general debt service fund regarding revenue adjustments was adopted.

q.      A resolution approving the facsimile signatures for the Rutherford County payroll account was adopted.

 

3.      HEALTH & EDUCATION COMMITTEE

 

a.      No report.

 

4.      PROPERTY MANAGEMENT COMMITTEE

 

a.      A resolution to request the Purchasing Committee to rescind its action on roofing the Health Department Annex was adopted.

b.      A resolution to approve the sanitary sewer and waterline easement with the City of Murfreesboro for the Siegel Property was adopted.

c.      A resolution to the storm drainage easement and temporary construction easement with the City of Murfreesboro for the County property where the adult detention center is located was adopted.

 

      5.  PUBLIC SAFETY COMMITTEE

           a.  A motion to suspend the rules to allow Phillip Martin address the

           Board regarding student resource officers was adopted.  A motion to

          apply for a grant to fund student resource officers was adopted.

     

6.   PUBLIC WORKS & PLANNING COMMITTEE

 

a.   No Report.

 

  1. STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE
