1.       Amendment to Conditional Use Permit (A-733) Request A-767: Cynthia Hollis; Present Zoning is Residential-15; Amend Conditional Use Permit for a  Dog Grooming & Training Facility to allow the following changes: 1) A front yard buffer of evergreen shrubs or trees a minimum of 4-foot in height and spaced 10-foot on center, or a 6-foot high privacy fence, 2) To allow fifteen (15) dogs to be on site and after one year to allow additional dogs at the Planning Director’s discretion; 3) To allow three special dog events a year of no more than 30 dogs with the owner notifying the Planning Department of the event; 4) To allow parking to be located in the front of the building; Size of the site: 5.5 acres.

2.       Amend Conditional Use Permit Request (A-742) A-769: Thomas Pierce for A-Plus Storage on Shelbyville Pike; Present Zoning: Services; Requested Zoning; Services; Amend Conditional Use Permit for a Mini Storage Warehouses to allow the following changes 1) To allow a 20-foot wide landscape buffer area parallel to Shelbyville Pike to consist of native trees and shrubs, the trees shall be 3-inches in caliper and shrubs shall be 2-foot in height, 2) Parking is permitted in the front of the office building, 3) The masonry wall of the mini-storage building will replace a free standing masonry wall. The mini-storage rear wall shall set on the 75-foot vegetative buffer line and the wall shall be continuous (no breaks) along the 75-vegetative buffer line;  Size of Site: 6.7 acres.

3.       Amendment to Conditional Use Permit A-229; A-766: Rutherford County at 1572 Mount Herman Road; Present Zoning: Commercial; Requested Amendment to A-229 to allow a six (6) – foot high stainless steel slotted fence on the east and south sides of the property in question and to remove the buffer from the west side of the subject property; and if Mr. Sharini sells either the subject property or the adjoining property on the west side of the subject property, he will be required to install the appropriate buffer as set forth in the Rutherford County Zoning Resolution on the west side of the subject property; if however, Mr. Sharini should sell the properties to the same entity, no buffer will be required on the west side; also, according to the Rutherford County Zoning Resolution, no buffer is required on the north side of the subject property;  Size of Site: 11.2 acres.

4.       Proposed addition  to the Rutherford County Zoning Resolution regarding the Definition of Residential Yard Sale: 

                        Amendment to Rutherford County Zoning Resolution: Article II Interpretations

                        & Definitions, Section 2.02 Definitions, Add : Residential Yard Sale: A sale,

                        which occurs no more than three (3) days in a ninety (90) day period of time,

                        and no more that four (4) times in a year. Items of sale are household or

                        personal items, which are generated from a residence. Yard sales in

                        conjunction with churches and non-profit organizations are exempt from this

                        definition.
