 THURSDAY, APRIL 17, 2003

 

A.        Chairman Nancy R. Allen called the regular session of the Rutherford County Board of Commissioners to order on Thursday, April 17, 2003 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee. 

B.        Commission Court Chaplain, Trey Gooch led the Invocation. 

C.       Boy Scout, Chaz Hazelwood led the Pledge of Allegiance to the Flag of the United States of America. 

D.       Twenty-one Rutherford County Board of Commissioners were present for the Legislative Meeting. 

E.        The March 13, 2003 Legislative Meeting Minutes were adopted as typed. 

F.        RESOLUTIONS OF APPRECIATION 

1.         The Resolution of Appreciation in honor of Mary Jean Goad was adopted.

 

G.       PUBLIC COMMENTS 

1.      None

RULES SUSPENDED 

1. Commissioner Tina Jones moved, seconded by Commissioner Paul Johnson to suspend the rules to present the first resolution under Property Management.  A resolution to approve the name of the new animal services facility be Rutherford County Pet Adoption & Welfare Services (PAWS) was adopted.

 

H.        ELECTIONS & CONFIRMATIONS 

1.      The Notary Public-at-Large Applications, as presented by the Office of the Rutherford County Clerk, were approved.

 

I.    UNFINISHED BUSINESS 

   1.  No Report.

 

J.    PUBLIC HEARINGS-6:30 P.M.             

  1. No one spoke for or against at the Public Hearing held with regard to the request from Daniel Tomberlain.  The request to rezone property located at 4247 Sulphur Springs Road from Residential-15 to Services with a Conditional Use Permit to allow a full service beauty salon and tanning salon was approved along with conditions as recommended by the Rutherford County Planning Commission.
  2. One person spoke for and no one spoke against at the Public Hearing held with regard to the request from EGS Transportation, L.L.C.  The request to rezone property located at 3922 Shelbyville Pike from Residential-15 to services with a Conditional Use Permit to allow can transportation services was approved along with conditions as recommended by the Rutherford County Planning Commission.
  3.  No one spoke for or against at the Public Hearing held with regard to the request from William A, Morris.  The request to amend the Conditional Use Permit A-583 to increase the size of the wall mounted sign to nine square feet was approved along with conditions as recommended by the Rutherford County Planning Commission.
  4. No one spoke for or against at the Public Hearing held with regard to the request from Tonya C. Allen.  The request to rezone property located at 3416 Shelbyville Pike from Residential-15 with a Conditional Use Permit to allow a massage therapy business was approved along with conditions as recommended by the Rutherford County Planning Commission.
  5. No one spoke for or against at the Public Hearing held with regard to the request from Nashville Super Speedway, USA, Inc.  The request to rezone property located at the corner of McCrary Road and State Route 452 from Residential-15 with a Conditional Use Permit to allow parking in conjunction with events at the Nashville Super Speedway in Wilson County was approved along with conditions as recommended by the Rutherford County Planning Commission.
  6. No one spoke for or against at the Public Hearing held with regard to the request from Don and Pam Stewart.  The request to amend the Conditional Use Permit A-408 to remove the requirements limiting the size of the sign and the requirements that the sign be ground mounted, low profile and unilluminated was approved along with conditions as recommended by the Rutherford County Planning Commission.

 

K.  MONTHLY & QUARTERLY REPORTS 

1.  The Monthly and Quarterly Reports were approved as mailed out.

 

              

L.  REPORTS BY STANDING COMMITTEES 

  1. PURCHASING COMMITTEE

a.      The purchasing committee report as mailed out was adopted.

 

2.      BUDGET, FINANCE & INVESTMENT COMMITTEE 

a.      A recommendation to amend the General Fund with regard to the following was adopted:

1.      County Executive

2.       Planning/Engineering

3.      Sheriff’s Department (4)

b.      A resolution to amend the Road & Bridge Fund was adopted.

c.      A resolution to amend the General Purpose School Fund was adopted.

d.     A resolution authorizing the County Executive to execute a Contract on behalf of Rutherford County to provide detention care services for any juvenile ordered into its custody by the Juvenile Court of Henry County at the rate of $125.00 per day for each juvenile detained was adopted.

e.      A resolution approving an agreement on behalf of Rutherford County with the Tennessee Department of Health for the purpose of protecting and improving the physical health of the State’s citizens was adopted.

f.        A resolution authorizing the County Executive to execute a contract on behalf of Rutherford County to hire Hart, Freeland and Roberts to develop the electrical and structural engineering plan for the County Archives location at the old Health Department was adopted.

g.      A resolution approving that two hundred thousand dollars ($200,000.00) be appropriated to renovate space in the Judicial Building for a courtroom for the Juvenile Court Judge was brought up but later amended.  Amendment #1 that eighteen thousand dollars ($18,000.00) for A/E design fee be removed from the total for a new total of one hundred eighty two thousand dollars ($182,000.00), and that the County Executive be authorized to sign a bi-party agreement for the purpose of constructing, renovating, and equipping the space for the Juvenile Judge courtroom was adopted.  The rules were suspended to allow John Neville to address the Board.  Amendment #2 that we request an estimate from the County construction manager, Tommy Brown, for renovating the space was brought up but failed.  The original motion as amended once was adopted. 

h.      A resolution approving a new fee schedule for the Building Codes Department was adopted.

i.        A resolution approving a contract with Griffin Industries for the removal of dead animals was brought up but later amended.  An amendment to defer for thirty days was brought up but failed.  The original motion was adopted.      

j.         A resolution to amend the contract in lieu of the Performance bond with the State of Tennessee, Department of Environment and Conservation to reduce the annual inflation adjustment of the finance assurance for Rutherford County regarding the Division of Solid Waste Management was adopted.

 

3.      HEALTH & EDUCATION COMMITTEE 

a.      No report.

 

4.      PROPERTY MANAGEMENT COMMITTEE 

a.      A resolution approving a bi-party agreement with the Public Building Authority for the preliminary design of a new Correctional Work Center and the Juvenile Detention Center was brought up but later amended.  An amendment to approve the bi-party agreement with the figure of twelve thousand dollars ($12,000.00), which has already been appropriated, was adopted.  The original motion as amended was adopted.

b.      A resolution approving a Standard Form of Agreement with MPACT for restoration of the Courthouse cupola was adopted.

 

      5.  PUBLIC SAFETY COMMITTEE 

a.   No Report  

6.   PUBLIC WORKS & PLANNING COMMITTEE 

a.     A resolution to approve a noise control resolution was brought up but later amended.  Amendment # 1 to include “school related activities and functions” under Section 2.e., regarding exceptions to the noise ordinance was adopted.  Amendment #2 to delete Section 2.d., removing dog barking from the exemptions was adopted.  Amendment # 3 to delete Section 1.5, removing “other than major subdivisions” was adopted.  The original motion as amended three times failed.

b.     The rules were suspended allowing a grant application that was not on the agenda to be brought before the Board.  A resolution in support of the fiscal year 2003 THDA Home Grant was adopted.

 

  1. STEERING, LEGISLATIVE & GOVERNMENTAL COMMITTEE

a.      No Report.

 

  1. ANY OTHER BUSINESS

a.  Commissioner Mike Sparks reminded the Commissioners about the rally for troops in Smyrna
      on Sunday, April 27, 2003 at 2:00 p.m.

            b.   Commissioner Robert Peay reminded the Commissioners about a country ham breakfast and
                  homecoming at Kitrell on the first Saturday of May.

                       

There being no further business, Madam Chairman, Nancy R. Allen adjourned the Rutherford County Board of Commissioners Legislative Meeting.
