LEGISLATIVE DIGEST OF THE RUTHERFORD COUNTY BOARD OF COMMISSIONERS
THURSDAY, JANUARY 23, 2003
A. Chairman Nancy R. Allen called the regular session of the Rutherford County Board of Commissioners to order on Thursday, January 23, 2003 at 6:00 p.m. in the Courtroom located on the second floor of the Rutherford County Courthouse in Murfreesboro, Tennessee.
B. Commission Court Chaplain, Trey Gooch led the Invocation.
C. Commissioner Jeff Phillips led the Pledge of Allegiance to the Flag of the United States of America.
D. Twenty Rutherford County Board of Commissioners were present for the Legislative Meeting.
E. A motion to correct and approve the Legislative Meeting Minutes from the November 14, 2002 meeting was adopted. The December 12, 2002 Legislative Meeting Minutes were adopted as typed. A motion to approve the video tape as Exhibit 1 to be included into the written minutes beginning in January, 2003 was adopted.
F. RESOLUTIONS OF SYMPATHY
1. The Resolution of Sympathy in memory of Thomas M. Lane was adopted. 2. The Resolution of Sympathy in memory of Hoyte Gordon Joyce was adopted.
G. RESOLUTIONS OF APPRECIATION
1. The Resolution of Appreciation in honor of Tela Bayless was adopted.
H. PUBLIC COMMENTS
1. Commissioner Bob Bullen introduced Dr. Joe Phillips as the new director of schools. 2. Commissioner Bob Bullen announced that reporter Bryan Brooks was leaving the Daily News Journal and his replacement, Jennifer Farish, was introduced.
I. ELECTIONS & CONFIRMATIONS
1. The Notary Public-at-Large Applications, as presented by the Office of the Rutherford County Clerk, were approved. 2. The Steering, Legislative & Governmental Committee recommended G. Jane Jackson and Tommy Gentry along with Commissioner Will Jordan to serve on the Agricultural Advisory Committee. Keith Elrod was nominated from the floor. The rules were suspended to allow Tommy Gentry and Keith Elrod to address the Board with a two-minute time limit. After discussion, G. Jane Jackson, Keith Elrod, and Commissioner Will Jordan were appointed to serve on the Agricultural Advisory Board. 3. The appointments of Thomas Hartley and Grant Kelley to the Correctional Work Center were confirmed. 4. A vacancy on the Conservation Board was announced. 5. A vacancy of the 7th District Constable was announced. 6. The appointment of Commissioner John Rodgers to the Tennessee County Commissioner Association Legislative Committee was confirmed. 7. The appointment of Amanda Stubblefield as Judicial Commissioner was confirmed.

K.. MONTHLY & QUARTERLY REPORTS
L. REPORTS BY STANDING COMMITTEES
a. The Purchasing Committee Report was adopted as mailed out.
2. BUDGET, FINANCE & INVESTMENT COMMITTEE
a. A recommendation to amend the General Fund with regard to the following were adopted: 1. Ambulance Service 2. Emergency Services 3. Sheriff’s Department b. A resolution approving the Facilities Master Plan with regard to the County office and Court space needs study was brought up but later amended. Amendment #1 to the original motion was made to change the second paragraph of the resolution to read as follows: Therefore be it resolved by the Rutherford County Board of Commissioners that Rutherford County proceed with the attached construction schedule with projects for the Archives Department, Correctional Work Center, Juvenile Detention Center, including Juvenile Judge Courtroom/Judge’s chambers and related services to begin in the 2002 – 2003 fiscal year. Amendment #1 to the original motion was adopted. Amendment #2 to the original motion was to amend the second paragraph of the resolution by adding the Criminal Justice Center into the construction schedule to begin in the 2002 – 2003 fiscal year. Amendment #1 to the original motion was adopted. The original motion as amended twice was adopted. c. A resolution approving a bi-party agreement for architectural/design services for Juvenile Judge Courtroom, Correctional Work Center and Juvenile Detention Center was adopted. d. A resolution approving funding for the development of the Beasley Road Connector from SR-96 to Burnt Knob Road was adopted. e. A resolution to approve repairs/replacement for HVAC and roofs for various schools was brought up but later amended. An amendment to also include in the next bond issue Four Million Seven Hundred Thousand Dollars ($4,700,000.00) to be utilized for grading, excavation, foundation, slabs, most masonry, steel work and most of the roof work for the new LaVergne Middle School, with the balance to be funded in fiscal 2004 and that the Five Hundred Thousand Dollars ($500,000.00) be utilized for the design of the new LaVergne Middle School and the design of the renovation of Roy Waldron School. Making the total needed Ten Million Nine Hundred Fifty Thousand Dollars (10,950,000.00) to be appropriated through the next bond issue and utilized for the purpose of providing funds for the design, grading, excavation, foundation, slabs, most masonry, steel work and most of the roof work of LaVergne Middle School, design of the Roy Waldron renovation, and repair and/or replacements of HVAC systems and roofs was adopted. The original motion as amended was adopted. f. A resolution to amend the general purpose school fund budget was adopted. g. A resolution authorizing the additional line-of-duty death benefits for all employees who are members of the Tennessee Consolidated Retirement System was adopted. h. Information regarding funding for Senior Citizens was presented. i. Discussion regarding the Finance Director position was brought up.

6. PUBLIC WORKS & PLANNING COMMITTEE
a. A resolution authorizing that Rutherford County become a signatory to the Early Action Compact and authorizing the County Executive to execute the Early Action Compact was adopted.
a. A resolution approving the Archives Implementation Committee was adopted. b. A resolution approving a check list for real estate transactions to be followed for purchase of real estate in future purchase transactions was adopted.
A motion to add the video tapes for the November, 2002 and December, 2002 meetings as Exhibit “1” was adopted.
There being no further business, Madam Chairman, Nancy R. Allen adjourned the Rutherford County Board of Commissioners Legislative Meeting.
